Dear Mr. Brook:
The Limited Site Assessment / Site Closure Request received by the UST Section, Division of Waste
Management, Mooresville Regional Office on November 18, 1999 has been reviewed. The review indicates that soil
contamination does not exceed the residential maximum soil contaminant concentrations (MSCCs), established in Title
15A NCAC 2L .0411. The Limited Site Assessment shows that groundwater contamination on the property exceeds 10
times the groundwater quality standards established in Title 15A NCAC 2L .0202. Groundwater contamination
documented on this property is related to Johnny's Midtown Texaco (UST Incident #18565). The UST Section is not
requiring a Notice of Residual Petroleum to be filed on this parcel since the groundwater contamination is related to
another incident.
The UST Section determines that no further action is warranted for this incident. All required actions have been
completed. This determination shall apply unless the UST Section later finds that the discharge or release poses an
unacceptable risk or a potentially unacceptable risk to human health or the environment. Pursuant to Title 15A NCAC
2L .0407(a) you have a continuing obligation to notify the Department of Environmental Quality of any changes that
might affect the risk or land use classifications that have been assigned.

site, the responsible party must continue to address contamination as required.
