Rick: I reviewed both incidents (22148 and 20372) and found there is not a notice of residual petroleum recorded for
either property. Both were granted No Further Action status. The letter for 20372 contained an error. The top portion
indicates that neither soil nor GW exceeds standards, but the lower part indicated that a land use restriction was
required. Records show that groundwater contamination documented on the site is associated with the nearby Texaco
release and therefore no groundwater restriction was required for incident 20372. So, in summary, there is no deed
restriction from the UST Section on this property. Hope this helps.

Ed, find attached the LSA report of 30 Market Street that was done recently and the NFA that we received back in 2001
when we removed a tank from the site.
The City would like to develop this site into a mixed use development that will consist of a 6 story building with 167
residential units and commercial space on the ground floor and below grade parking. We would like to have the
restriction of "no residential development" removed so we can develop the site. No soil contamination was found on
the most recent LSA, and we propose to install a vapor intrusion mitigation system as part of the development.
Please let me know what the City needs to do to have the restriction removed.
