3A, 3B, 4A, 4B, 5, 6A, 6C, 6D, 6E; New Hanover County Landfill, permit 6504-MSWLF-2017 Cell 7; Permit to
Construct (PTC) New Hanover County Landfill, permit 65-04-MSWLF-2017 Cells 8-13 issued 3 January 2019.
Pursuant to NCGS 130A-294(a2), this life-of-site PTO shall expire when the facility reaches its final permitted
elevations.
PURPOSE OF SITE VISIT:
Partial Facility Compliance Inspection
STATUS OF PAST NOTED VIOLATIONS:
None applicable
OBSERVED VIOLATIONS:
1) 15A NCAC 13B .0505 (1)(a) states “Construction plans shall be approved and followed.”
2) 15A NCAC 13B .0505 (2)(a) states “Solid waste shall be restricted into the smallest area feasible.”
3) 15A NCAC 13B .0505 (2)(b) states “Solid waste shall be compacted as densely as practical into cells.”
4) 15A NCAC 13B .0505 (3)(a) states “Solid waste shall be covered after each day of operation, with a
compacted layer of at least six inches of suitable cover or as specified by the Division.”

5) 15A NCAC 13B .0505 (4)(b) states “Adequate erosion control measures shall be practiced to prevent
excessive on-site erosion.”
6) 15A NCAC 13B .0505 (6)(b) states “Temporary seeding will be utilized as necessary to stabilize the
site.”
7) 15A NCAC 13B .0505 (12)(b) states “Appropriate methods such as fencing and diking shall be
provided within the area to confine solid waste subject to be blown by the wind. At the conclusion of
each day of operation, all windblown material resulting from the operation shall be collected and
returned to the area by the owner or operator.”
Please see the ADDITIONAL COMMENTS section below for details concerning the violations listed above.
ADDITIONAL COMMENTS:
1) This Facility is a Municipal Solid Waste Landfill, a Small, Type 3 Composting Facility, and a Materials
Recovery and Recycling Facility.
2) This Facility is permitted to receive Municipal Solid Waste, Construction & Demolition Waste, Yard Waste,
Land-clearing Debris, and Scrap Tires generated in New Hanover County.
3) Proper signage including the Facility permit number, accepted waste types, banned or excluded items, hours
of operation, and the emergency contact number is posted at the Facility entrance.
4) The Facility is secured by means of a locked gate at the Facility Entrance.
5) The Facility access road is of all-weather construction and is being maintained in overall good condition.
6) The hours of operation are Monday through Friday 6:30 AM to 5:00 PM and Saturday 6:30 AM to 12:00 PM.
Three Holidays are observed: New Year’s Day, Thanksgiving Day, and Christmas Day.
7) This Facility is approved for the use of Posi-shell as an alternative daily cover system.
8) The compost element of this Facility was reviewed during this Facility Compliance Inspection.
9) Compost operations were underway during this Facility Compliance Inspection.
10) The leachate collection system cleanouts are highly visible, readily accessible, protected, and well maintained.
11) Leachate is stored in on-site leachate containment lagoons until treated in an on-site reverse osmosis system
before being discharged to the Cape Fear River.
12) Windblown debris was observed on the outside slopes of the landfill and collected in various areas around the
facility including the surface water ditches and sedimentation control ponds. *All windblown materials should
be collected at the end of each workday and returned to the active working area for proper disposal.
13) Leachate seeps were observed on the outside slope on the southwestern side of the landfill. *Within 14 days
of receipt of this Facility Compliance Inspection Report, please ensure that corrective measures are
implemented and that all leachate seeps are properly repaired using best management practices to prevent
leachate from leaving the permitted waste disposal area.
14) This Facility is maintaining more than one active working face. *Within 14 days of receipt of this Facility
Compliance Inspection Report, please ensure that the Facility maintains only one active working area. All
areas outside of the active working face should be compacted and covered.
15) The majority of the top lift of the landfill has not been covered as required and does not appear to have been
covered in some time. *Within 14 days of receipt of this Facility Compliance Inspection Report, please
compact and cover the top lift of the landfill and, moving forward, ensure that the active working areas is
covered as per your approved Operations Plan-see Attachment 3 Part I #34 (a)(b) and (c) on pages 15 and 16
of the Approved Plan.
16) The waste type in the landfill was reviewed; overall, the waste type being disposed is MSW. However, one
whole scrap tire was observed disposed at the active working area. Mr Hawes collected the tire and removed

with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

it from the landfill during this Facility Compliance Inspection. *Please ensure that all incoming waste is
properly screened to ensure that all banned/excluded waste types are removed from the waste stream and
properly managed.
17) Eroded areas were observed on the southwestern outside slope of the landfill. *Within 14 days of receipt of
this Facility Compliance Inspection Report, please repair all eroded areas by filling, grading at a slope not
greater than 3:1, and then seeding and mulching to establish a groundcover suitable to prevent erosion of your
landfill cap system.
18) The Materials Recovery and Recycling Operation is currently being used as an on-site waste storage and
transfer area. Smaller vehicles are being diverted to this area to reduce traffic flow at the landfill working
face. *Please be advised that any planned changes to your approved operations should be submitted to the
Section for approval before commencing operations.
19) *Corrective measures are required as a result of this Facility Compliance Inspection.
