Mr. Morris,
On behalf of my client, J.B. Hunt, I am reporting the release of diesel fuel from a Semi -
Tractor Trailer accident. On February 4, 2009, a J.B. Hunt truck was struck by an Amtrak train
north of Harrisburg, NC on Hwy 49 in the area of Pharr Rd around 1 Oam est. Once notified I sent
a contractor to the site for clean up. The contractor hired by PES was FCC Environmental. When
representatives from Norfolk Southern arrived they informed FCC that they were not Norfolk
Southern approved contractors and could not work with -in 25-feet of the center of the track. FCC
was informed that Norfolk Southern had made contracted another company, Hepaco, to do
cleanup. Hepaco is not a PES approved contractor. PES then contacted A&D Environmental to
respond as they are both a Norfolk Southern and PES approved contractor.
When A&D arrived on site they were also denied access to the area within 25-feet of the
center of the track. They were able to cleanup an area that a fuel tank had landed in that was
outside the 25-feet radius. The diesel tank was drained and the small amount that had leaked out
was hand dug to be disposed of.
We do not have any information as to what plans Norfolk Southern and Hepaco have for
the area inside the 25-foot radius of the tracks. They were overheard talking about applying Bio-
remediates. There is no knowledge as to if this application has taken place or not. No one would
share information with us.
PES, on behalf of J.B. Hunt, has made every effort to remediate the impacted area. We
even hired a contractor (A&D) that is a Norfolk approved contractor and we were still denied the
access to remediate an incident that J.B. Hunt is responsible for.
