Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on January 15, 2019. 2. The facility is owned by Haywood County and operated by Santek Environmental of North Carolina, LLC 3. The service area for the facility is Avery County, Buncombe County, Burke County, Cherokee County, Clay County, Graham County, Henderson County, Jackson County, Macon County, Madison County, McDowell County, Mitchell County, Polk County, Rutherford County, Swain County, Transylvania County, and Yancey County. Records Review 4. Methane monitoring is being conducted on a quarterly basis by Environmental Monitoring Services, LLC and records were available for review. Monitoring was conducted at landfill gas monitoring wells 1, 2, 4R, 7, 8, 9, 10, maintenance building and the scale house. The monitoring was performed on February 15, 2018, May 8, 2018, August 23, 2018, November 19, 2018 and no exceedances were noted. 5. Leachate hauling logs were reviewed. Records indicated the facility hauled 3 million gallons of leachate to the Town of Waynesville Wastewater Treatment Plant in 2018. 6. Leachate daily head logs and maintenance records from December 2017 to November 2018 were available for review. Some inspection dates were missing from the forms. Please ensure that the date of the inspection is noted on the form. 7. Groundwater monitoring was conducted on October 25-26, 2017 and April 25-26 and May 1, 2018. Both reports had exceedances of the 2L standard. 8. Daily tonnage records from January 2018 to December 2018 were available for review. The facility disposed of 149,463 tons during 2018 which is within the maximum variance allowed by GS 130A-294(bl)(1) of the permitted amount of 146,000 tons. 9. Asbestos disposal records from 2018 were available for review. When asbestos is received the facility records the latitude, longitude and the elevation where the material was buried. 10. A current Manager of Landfill Operations (SWANA) or Certified Landfill Manager (Joyce) certificate could not be produced at the time of inspection as required by GS 130A-309.25. By February 1, 2019, a copy of a current Manager of Landfill Operations or Certified Landfill Manager certificate must be provided by email. Email the current certificate to: lee.hillnncdenr.2ov 11. North Carolina Certified Landfill Operator • Mike Kirkpatrick (expires August 4, 2019) 12. In order to be in compliance with GS 130A-309.25 and Permit Attachment 3 Part I (8), the facility must have a Certified Landfill Manager on staff and a Certified Landfill Operator on site anytime the facility is open to the public. The facility only has one Certified Landfill Operator on staff. Therefore, to comply with GS 130A-309.25 and Permit Attachment 3 Part I (8) that person must be on site at all times. It is recommended that additional facility staff become Certified Landfill Operators to avert the possibility of having additional enforcement actions including penalties and injunction from operation due to the lack of having certified staff on site. 13. Waste screening forms from January 3, 2018 to January 14, 2019 were reviewed and found to be complete. The final disposition of any unacceptable waste detected was included on the forms. Page 2 of 6 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section Operations Inspection of the MSWLF Unit (4407) 14. The Permit to Operate the newly constructed Phase 4 was issued on December 21, 2018 but the facility has not begun fill activities in this cell at this point. 15. The working face appeared to be of manageable size and no unapproved material was observed. 16. The top of the landfill lift had good soil cover and the access road was well maintained and in good condition. 17. Windblown litter was well managed at the time of inspection. The facility employs four temporary workers, two days per week to pick up litter at the site. 18. The side slopes of the landfill were observed to have good soil cover. A small amount of rill erosion was observed on the western slope; however, no waste was exposed in these areas. Facility staff stated that repair work on the slopes was continuing as weather conditions permitted. Please continue to address erosion issues as they arise. 19. The southern slope of the landfill has been matted and seeded. Two dark areas observed on this slope appeared to be leachate seeps. Closer inspection of the areas revealed no leachate on the surface at the time of this inspection. Please continue to monitor these areas regularly for seeps that may occur. 20. The leachate pond had adequate freeboard, and the pond liner appeared to be in good condition. 21. The facility was in process of cleaning sediment basins but had to postpone further activity because of wet conditions. Facility staff stated the cleanout activities would resume when conditions became favorable. 22. Mr. Whitner stated that a camera had been installed at the scale house so that incoming loads could be more thoroughly inspected. Operations Inspection of the Mulching and Grinding Treatment and Processing Area 23. The Mulching and Grinding Treatment and Processing Area is located to the south of phase 2 of the MSW landfill. 24. The facility accepts unpainted, untreated wood, brush and unpainted/untreated pallets for grinding. 25. Facility staff had been moving wood waste material to create more area for grinding operations. As a result, some wood waste had fallen over the embankment, and some material had been mixed with soil. Ensure that all wood waste is collected and returned to the stockpile. 26. A small pile of household trash, including a sink and some plumbing material, was observed along the access road at the west end stockpile. Mr. Whittier stated that there had been problems with illegal dumping in this area. Please collect the household trash and dispose of the material properly in the working face of the landfill. It is recommended that control measures be implemented to restrict access to this area of the facility and prevent illegal dumping activities.
