STATUS OF PAST NOTED VIOLATIONS:
None
OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee shall be considered
to have accepted the conditions of the permit and shall comply with the conditions of the permit.”
General Permit Condition Number 11 of Permit to Operate 36-14-Compost states: “An appropriate Division
of Energy, Mineral and Land Resources (DEMLR) permit for managing any stormwater and/or wastewater at the
facility must be maintained, if required. Any leachate generated at the facility and any runoff from the facility
must be managed in such a manner that ground or surface water quality will not be adversely affected. The

facility must be maintained to prevent the accumulation of stormwater and leachate on composting areas, storage
areas, and roads.
During the inspection stormwater and leachate was observed NW of the storage area and between the storage area
and retaining wall located south of the “Black Gold” compost. Due to wet weather conditions drain lines will be
videoed to determine blockage by January 12, 2019.
City of Gastonia is in violation of 15A NCAC 13B .0203(d) in that they did not maintain the stormwater
and leachate in a manner to prevent the accumulation on composting areas, storage areas and roads.
City of Gastonia was in violation of 15A NCAC 13B .0203(d) for failure to manage any leachate generated
at the facility and any runoff from the facility in such a manner that ground, or surface water quality will
not be adversely affected. The facility must be maintained to prevent the accumulation of stormwater and
leachate on composting areas, storage areas, and roads. Facility staff provided photographic
documentation on January 15, 2019 via email showing the accumulation of stormwater and leachate has

drained, therefore the violation is considered to be RESOLVED.
ADDITIONAL COMMENTS
1. The facility is permitted as a Large, Type 1 Solid Waste Compost Facility.
2. Proper signage was observed at the entrance to the facility.
3. Access road into the facility was in good operational condition.
4. The facility is located on the grounds of the City of Gastonia – Duke Street Composting Facility.
5. The facility only accepts wastes that are generated by the City of Gastonia.
6. The current permit and operations plan is maintained in the office of Dee Dee Gillis, Division Manager of Solid
Waste. During the inspection a copy of the current permit and operations plan was not found in the on-site plastic
document box. Mr. Hendrickson was informed and stated a replacement copy will be put in the on-site plastic
document box.
7. Gaston County’s leaf collections season is from October 1 to March 31. Yard waste passively compost until
grinding of ward wastes which typically is done on-site two to three times a year.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

8. The facility was actively receiving yard waste during the inspection.
9. Temperature records were reviewed from 3-7-18 to 1-3-19. Temperatures are taken once a month except before
selling to the public. Prior to the sale of “Black Gold” temperatures are taken 3 continuous days to ensure the 101
degrees F ensuring that the pathogen reduction criteria are met.
10. No prohibited wastes were observed. Two rollout containers are located on the property to deposit the occasional
unacceptable waste.
