You are in violation of the above rule in that erosion of the landfill cap was observed on all side slopes. 15A NCAC 13B .0505 (5)(b) Surface water shall not be impounded over or in waste. You are in violation of the above rule in that water was observed impounded over waste unit. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 7 15A NCAC 13B .0505 (5)(c) Completed areas shall be adequately sloped to allow surface water runoff in a controlled manner. You are in violation of the above rule in that ponded water and areas of erosion were observed over the landfill cap. 15A NCAC 13B .0505 (6)(a) & (b) Vegetation Requirements You are in violation of the above rules in that bare areas of soil and erosion remain across the landfill cap. ADDITIONAL COMMENTS 1. The purpose of this inspection was to conduct a follow up closure evaluation of the Bladen Co. Closed MSW – NCDOT recapping project. 2. The gate at the facility did not appear to have been secured. Vegetation was growing through the opened gate. The site shall be secured when staff are not on site. 15A NCAC 13 B .0505 8(a). 3. The facility access road was severely eroded. Per 15A NCAC 13 B .0505 8(c) the access road to the site shall be of all-weather construction and maintained in good condition. 4. Any waste protruding through the cap must be removed and properly disposed. Cable/wire was observed protruding from the cap. 5. Trees shall be removed from within the waste unit. 6. Water was observed ponded within the limits of waste during this inspection. 7. Erosion was observed across the entire area of the capping project. 8. Large rocks and gravel protruding from the cap must be adequately covered or removed. 9. It was apparent that the cap had been seeded with grass but, large areas of bare soil remain. The cap shall be reseeded as necessary until permanent vegetation/stabilization is achieved. 15A NCAC 13B .0505 (6)(a) & (b). 10. Corrective measures are necessary as a result of this inspection and shall be completed within 30 days’ receipt of this report. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
