Expires August 20, 2073. Recorded in the Currituck County Register of Deeds Book 1264, page 604. PURPOSE OF SITE VISIT: Complaint STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS: 01 – This facility inspection was conducted due to a complaint that was received by John College by a phone call. 02 – The complaint was that there was windblown trash left after working hours and solid waste left on the tipping floor of this transfer station overnight. 03 – Upon arrival, it was noted that this transfer station was under renovating this facility. This project was discussed during the last inspection. 04 – Push Walls where being repaired to keep solid waste from getting behind them. 05 – Some of the Exterior Metal was taken off to do the push wall repairs and to replace some of the panels with new ones due to holes in them which allowed for some solid waste to fall outside of the building. 06 – This had allowed for some windblown trash to blow outside of the building and staff had not picked it up at the end of the working day. Corrective action was needed. 07 – Josh Smaltz and his staff picked up the trash by the end of today and will continue to make sure this is done daily as required by their permit. Josh sent pictures of the areas in question to John College today at 5:44 pm by email to confirm this issue had been corrected. Some pictures attached to this report. 08 – As to the solid waste left on the tipping overnight, Josh Smaltz told John College that the solid waste was only left overnight due to a lack of trailers to fill. The solid waste left was single stream recyclables. 09 – This also was corrected today and will not happen again per their permit conditions does not allow for solid waste to be stored on the tipping floor. 10 – It was discussed during this inspection, that having extra trailers/containers available would prevent this from happening again. If the facility does not have enough trailers/containers to handle incoming solid waste, the facility should re-direct loads to another permitted facility that can take this solid waste. 11 – This facility was permitted without any type of leachate system and plans are being made to install water for washdown and fire suppression. This will require some type of leachate system. Ethan Caldwell – Division of Waste Management (DWM) Engineer was contacted today by John College and Josh Smaltz to ensure this facility sends all information to the DWM Engineers for approval before construction of this system is started. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
