PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0505(5)(b) states: “Surface water shall not be impounded over or in waste.” PPG Industries Fiber Glass Products, Inc. is in violation of 15A NCAC 13B .0505(5)(b) for allowing surface water to be impounded over waste. During this inspection, areas of ponded water were observed on the landfill cap that appeared to be 6” or greater in depth. To achieve compliance, PPG Industries Fiber Glass Products, Inc. must repair areas of the landfill cap where settling has occurred to eliminate the depressions that permit water to pond over waste and provide for the FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 sheet flow of surface water over the site. ADDITIONAL COMMENTS 1. Documents on file for this permit indicate that the facility opened in 1980 and received a closure letter on December 2, 1998. In addition, the Division of Waste Management (DWM) received notification of the change in ownership from PPG Industries, Inc. to PPG Industries Fiber Glass Products, Inc. 2. Ms. Tinsley stated that PPG Industries Fiber Glass Products, Inc. had been purchased by Nippon Electric Glass. However, no record exists in DWM files regarding this change in ownership. Please provide a copy of the deed showing transfer of the facility to Nippon Electric Glass. 3. Access roadways are paved and in good condition. 4. The entire permitted acreage is surrounded by chain link fence and secured with a locking gate. 5. The facility appeared to be well maintained, with established vegetative cover that had been mown recently. 6. Ms. Tinsley stated that grounds maintenance occurs as often as necessary, but normally on a monthly basis. 7. The majority of the landfill cap appeared to be in good condition. However, several small areas along the northern fence line were bare where the clay surface appeared to have hardened and choked out vegetation. Please ensure that maintenance is performed to break up the clay surface and apply seed to these areas to re-establish vegetative cover. 8. Two small areas of ponding water were observed near the central portion of the landfill cap where the fill had subsided. Ensure that maintenance is performed to reshape the landfill cap and eliminate the depressions that allow water to be impounded over the waste in the landfill. (see Observed Violations section of this report for additional information.) 9. No landfill gas or groundwater monitoring takes place at the facility. Monitoring wells were abandoned as part of the closure process. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
