As a follow-up to our verbal notice to Ms. Shawna Caldwell of your office, we are
providing written notice regarding the discovery of free product at the above -referenced site on
December 14, 2004. .
Our client, Kale Company, is the current owner of the site, which was formerly occupied
by a Kmart store. It is our understanding that Kmart removed three underground storage tanks
("USTs") from the site in 1991 and performed some product recovery in 1992, but never
completed the groundwater remediation. As owner of the property, our client repeatedly
requested that Kmart complete the remediation, but they refused and subsequently declared
bankruptcy. Last fall, Kale Company retained Veritech to complete the remediation started by
Kmart.

On December 14, 2004, Veritech's subcontractor, David Mursch, P.E., measured product
in three wells as follows:
MW-2
0.7 feet
MW-9
0.8 feet
MW-10
0.7 feet
After the measurements, the first round of Aggressive Fluid/Vapor Recovery ("AFVR") was
performed at the site. The wells were evacuated for approximately six hours using an AFVR
truck, and produced 3,095 gallons of water and product. It is estimated that approximately 300
gallons of the material recovered was free product. On the day after the first AFVR event, the
wells were re -checked and the product thickness was measured as follows:

0.4 feet
MW-9
0.2 feet
MW-10
0.1 feet
Another AFVR event is scheduled for this week, and the wells will be sampled in early
February after two rounds of AFVR.
