Land Clearing and Inert Debris Landfill Notification approval letter dated April 5, 2013 issued by the SWS to Robert Johnson. PURPOSE OF SITE VISIT: Follow-up Inspection STATUS OF PAST NOTED VIOLATIONS: Unresolved (see additional comments) OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT e��D—EQ Division of Waste Management .'­"\-r� Solid Waste Section ADDITIONAL COMMENTS Approval for operation of a Land Clearing and Inert Debris (LCID) landfill at Double R Farm LCID Landfill was granted on April 5, 2013, for disposal of land clearing and inert debris as long as the facility does not exceed 2 acres in size. LCID landfill as defined in Rule .0101(54) means a facility for the land disposal of land clearing waste, concrete, brick, concrete block, uncontaminated soil, gravel and rock, untreated and unpainted wood and yard trash. The following (bold) compliance issues still need to be resolved within 30 days of receipt of this report to prevent the issuance of Notice of Violations: 1. UNRESOLVED: LCID boundary markers were still missing on one corner of the landfill. The other corner had been installed. 2. UNRESOLVED: Total waste disposal area must be under 2 acres and 100 feet from property lines. At the time of the inspection, waste exceeded the 2-acre boundary markers on the west side of the landfill. UNRESOLVED: Several of the side slopes of the LCID landfill are steeper than a 3:1 ratio. These slopes must be brought into compliance. RESOLVED: 15A NCAC 13B .0566 (10) states: Surface water shall be diverted from the working face and shall not be impounded over waste. Water was observed ponding in an area of the LCID. All areas of the LCID must be graded to ensure proper flow of water. 5. The site is secured by a locked gate. 6. The facility has a sign visible from the road. The sign must include the Notification number and a telephone number for emergency contact. 7. The facility is doing a good job of separating out non-LCID waste.
