"Pursuant to 15A NCAC 13B . 0201(g), no later than December 11, 2018, the owner or operator must submit a request to the North Carolina Department of Environmental Quality, Division of Waste Management, Solid Waste Section (Section) for permit review and must update pertinent facility plans including, but not limited to, the facility operation and waste screening plans. " 3204-COMPOST-1991: Permit to Operate was issued on July 9, 2018 and expires on July 9, 2023 3212-TRANSFER-2014: Permit to Operate was issued on August 15, 2018 and expires on May 12, 2059 (life of site renewal of operations). PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: Page 1 of 5 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 3212-HHW-2014: The City of Durham Household Hazardous Waste Facility, located at 2115 E. Club Boulevard, is approximately 45,000 square feet. Several solid waste management facilities/areas are also located on the property including a swap shop and areas for tire collection, metal collection and electronic waste collection. It is situated on the same property as the City of Durham Transfer Station, Permit 3212T, closed MSW Landfill, Permit 3201, and Compost Facility, Permit 3204. This facility is permitted to receive household hazardous waste (HHW) generated by the residents within Durham, Chatham, Orange, and Wake Counties. To be defined as "household" waste, the waste must be generated by individuals on the premises of a residence for individuals (a household) and composed primarily of materials found in the wastes generated by consumers in their homes. Permit to Construct and Operate issued June 11, 2014 and expires on June 11, 2019. "Pursuant to 15A NCAC 13B .0201(g), no later than December 11, 2018, the owner or operator must submit a request to the North Carolina Department of Environmental Quality, Division of Waste Management, Solid Waste Section (Section) for permit review and must update pertinent facility plans including, but not limited to, the facility operation and waste screening plans. " The following observations were made during the November 21, 2018 inspection 1. A responsible individual trained in facility operations was onsite during operating hours. 2. The facility was adequately secured by means of gates, chains, berms, fences, or other security measures approved by the Section to prevent unauthorized entry. Signs were posted at the entrance to the facility stating the hours of operation and other pertinent information. 3. EcoFlo Inc. manages the operations of the HHW. 4. The HHW area was kept clean and organized with a good flow for traffic. 3204-COMPOST-1991: The Durham Compost Facility is located at 2115 E. Club Boulevard, behind the closed City of Durham MSW Landfill, Permit 3201. The property also contains the City of Durham Transfer Station, Permit 3212 and the City of Durham Household Hazardous Waste Facility, Permit 3212. In 2018 the permit was modified to change the compost method from windrow to aerated static pile (ASP). The facility is permitted to accept only yard waste, land clearing debris, and clean wood waste (Type 1) for processing (grinding) and composting. Page 2 of 5 FACILITY COMPLIANCE INSPECTION REPORT e��D_EQ Division of Waste Management Solid Waste Section The following observations were made during the November 21, 2018 inspection: 1. Temperature records were observed for the windrow method from May 23, 2018 through September 7, 2018 and for ASP from September 10, 2018 through November 20, 2018. 2. The facility processes approximately 15,000 to 17,000 tons per year. 3 Due to heavy, consistent rains, some areas of the compost facility were rutted and holding water. When the weather dries un. repair these areas. 4. Atlas Organics manages the operations of the compost facility. The overall facility operations appeared to be very well run. 5. No trash and unacceptable wastes was observed. Good job 3212-TRANSFER-2014: The owner of the City of Durham Transfer Station is the City of Durham, and the operator is Waste Industries, LLC. The City of Durham Transfer Station is located at 2115 E. Club Boulevard. The property also contains the Durham Compost Facility, Permit 3204, the closed City of Durham MSW Landfill, Permit 3201, and the City of Durham Household Hazardous Waste Facility, Permit 3212. In addition, the closed City of Durham Transfer Station, 3212T- TRANSFER-1999 is next to the new transfer station. This facility is permitted to receive municipal solid waste generated within areas consistent with the service area of the receiving landfill. Waste must be transported for disposal to an appropriately permitted sanitary landfill. The facility is also permitted to receive white goods and scrap tires. The following, at a minimum, must not be accepted for disposal at the facility; hazardous waste, liquid wastes, regulated medical waste, sharps not properly packaged, regulated -asbestos containing material. The facility is designed to transfer 650-1,100 tons per day of waste. The estimated annual tonnage for the facility is 124,000 tons of MSW, however, the facility may accept up to 200,000 tons per year. Hours of operation are Monday - Friday 7:30-4:30 and Saturday 7:30-12:00. The closed transfer station (3212T-TRANSFER-1999) was empty and only used for storing trucks/trailers during heavy storm events such as hurricanes and ice/snow storms. 2. The facility maintains a record of the amount of solid waste received at the facility, including daily records of waste received and origins of the loads. The transfer station is currently processing approximately 400-700 tons of waste per day and 157,00 tons of waste per year. 3. Electronic waste (e-waste) was being recycled by Powerhouse Recycling Inc. 4. A responsible individual trained and certified in facility operations was on -site during operating hours. Random inspections were being conducted and recorded on at least 1 % of loads or once per day, as part of the waste screening program. Records of these inspections were observed from January 9, 2018 through November 20, 2018. Great job! 7. Control measures were utilized to minimize and eliminate visible dust emissions and blowing litter. There was minimal windblown material and no windblown material was allowed to leave the facility boundary. Records for pumping of leachate tanks were observed for March 19, 2018, June 19, 2018 and September 19, 2018. 9. Facility operations are managed by Waste Industries, LLC.
