This letter serves as an annual status report providing the information required by the Brownfields
Agreement ("BFA") for the Powers Site (BP #20045-16-060) made effective on October 5, 2017.
In accordance with BFA Section V.15.j., within 90 days after each one-year anniversary of the
effective date of the BFA for as long as physical redevelopment of the Brownfields Property
continues, the owner of the Brownfields Property shall provide the North Carolina Department of
Environmental Quality Brownfields Program (DEQ) a report subject to written DEQ approval on
environment -related activities since the last report. This 2018 annual report was prepared by Civil
& Environmental Consultants, Inc. (CEC) on behalf of SC7 (IDR) LLC, SC7 (IDR Family) LLC,
and REI Holdings 2, LLC ("Prospective Developer").
Site redevelopment activities completed during the reporting period are discussed below.
Removal of AM Radio Transmission Tower and Associated Equipment
An AM radio transmission tower and associated equipment shed, which were installed on the
subject property by a radio company in 2005 under lease agreement with the former property
owner named Eagle Tremont, LLC, were removed by the radio company in June 2018. After
purchasing the property, the Prospective Developer entered into a new lease agreement with the
radio company. This (now former) tenant, contrary to the terms of the effective lease agreement
with the Prospective Developer, entered the property by cutting the chain -lock at the gate and
removed the AM radio transmission tower and the associated equipment shed building.
On behalf of the Prospective Developer, CEC personnel visited the site on June 19, 2018 to survey
the potential environment impact from the tower/shed decommissioning. CEC personnel noticed
that the lock on the chain securing the gate had been cut to allow unauthorized access to the site.
The entry gate was re -secured with a new lock. In the former tower area, CEC personnel observed

brush clearing and surface grubbing resulting in minor surface soil disturbance and the creation of
a few small piles of surficial soils. In addition, a limited excavation pit and associated small soil
stockpile were observed at the shed location as a result of the removal of subgrade wiring adjacent
to the remaining concrete slab. Based on the site observations, it is CEC's opinion that the former
tenant's activities will not increase the potential for sediment runoff or other environmental risk
factors at the site. When site grading activities are commenced, these disturbed materials will be
managed in accordance with the Environmental Management Plan (EMP) guidelines for soil
disturbance and removal, as necessary.
CEC reported this incident via email to the DEQ on June 19, 2008 providing a brief summary and
photographic documentation. A copy of this email is included with this report. Also attached is a
copy of DEQ's Memorandum of Communication dated June 21, 2018 regarding the reported
incident.
DEQ Approval of Environmental Management Plan
On behalf of the Prospective Developer, CEC prepared an Environmental Management Plan
(EMP) for site redevelopment. The EMP was approved by the DEQ on September 18, 2018.
Site Redevelopment Status
During this reporting period, the start date for site redevelopment was pushed back to allow for
changes to architectural and building structural details desired by the Prospective Developer. As
of this reporting, a tentative start date has not been re -scheduled.

site environmental conditions relevant to the Brownfields site development. Please contact me

Jordan,
Here are the photos from the site visit today. The tenant, going against their lease agreement, entered the property by
cutting the chain/lock at the gate and removed the am radio tower and the associated shed building. While some soils
were displaced and some piles moved around, it does not appear likely to have increased the chances of runoff, or other
risk factors at the site. Same soils as we have always had, just some new piles of surficial soils from them scraping and
pushing back vegetation and some of the old stockpiles of asphalt and soil have been moved around.

On June 19, 2018, a representative of Civil and Environmental Consultants (CEC)
contacted the Mooresville Regional Office Brownfields Staff to state than an AM Radio
tower and associated ground wires and utility building had been removed from the
abovementioned Brownfields Property by the former tenant without the knowledge of the
current property owner or an approved Environmental Management Plan (EMP). The
removal of the structures was discovered on June 18th by the property owner and was
subsequently reported to the Brownfields Program.
Based on a site inspection by CEC, the security fence gate was cut to facilitate removal of
the structures. Surficial soils were apparently moved on the site to access the base of the
tower, ground rods and subgrade utility features. However, it does not appear as though
any soils were removed from the Brownfields property. CEC stated that, though soils were
relocated on -site, it did not appear that there was an increased potential for soil runoff or
stormwater issues. The entry fence was re -secured by CEC on June 19, 2018.
Photographs of the disturbed areas were submitted to the Brownfields Program and are
attached for reference. CEC and the developer were instructed by the Brownfields Program
to re -secure the fence and that, once the EMP is approved, the previously disturbed soils
can be managed in accordance with the EMP guidelines for soil disturbance and removal
as necessary.
