STATUS OF PAST NOTED VIOLATIONS:
.0838(a)(18) This office did not receive a copy of a crop evaluation (with advice concerning crop issues) from a
regional agronomist or extension agent as noted on the audit of 6/27/2018. Provide this office with a copy asap.
OBSERVED VIOLATIONS:
1. .0838(a)(18) Approved nutrient management plans shall be followed. Permit Condition 2. This site shall be
operated and maintained in accordance with the nutrient management plan. A significant amount of vegetation
other than fescue (the approved cropstand) is still present on both permitted fields. Noted that reseeding had been
done - saw signs of new growth. Refer to “status of past noted violations” above. Failure to reestablish an
adequate fescue cropstand will result in site closure.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Soil samples were required to be taken by the permit holder by December 31, 2018. At this time it does
not appear that this office has received a copy of the soil report yet.
2. The required signs are posted and the access road is adequate.
3. During this visit noted that a recent discharge event had occurred on Field 1B – checked the ph and it was a pH
5 (not the required pH 12), however unsure exactly when the discharge event occurred or if recent rains affected
the reading. Ensure that all waste is at a pH 12 at the time of discharge.
4. Field markers appear accurate on both fields. It appears that the approved setbacks are being met but were not
measured at this time. No sign of land application outside the permitted boundaries. No sign of heavy
application.
5. The permit submittal is currently under review.
