Piedmont Industrial. Services Inc. (PIEDMONT) appreciates the opportunity to provide for your
environmental service needs. The following is a summary of results for the UST closure and soil
sampling event conducted at the above reference site on October 10, 2018.
On October 10, 2018, Tom Lennon with Piedmont Industrial Services provided oversight of
closure of a former 550 gallon non- regulated residential heating oil tank at 821 Coulwood
Drive in Charlotte, Mecklenburg County. A site location map is presented as Figurel. A site
map with former UST and soil sample location is provided in Figure 2. The UST closure was
completed by Salem Environmental in conjunction with Zebra Environmental.
Site History:
In June of 2017 the North Carolina Department of Environmental Quality (NCDEQ) Division
of Waste Management, UST Section issued the former owners of the subject property ( Thomas
and Linda Digiampaolo) a Notice of Violation (NOV 10/31/2017) resulting from a release
from the subject UST. The fill pipe on a 550 gallon heating oil tank was cut off and it resulted in
a surface waters entering the tank during a rain event. Product carried by rain water drainage
flowed off the subject property and impacted the adjacent down gradient property. A review of
available files appears to indicate that the surface release was cleaned up. However, the subject
550 gallon heating oil tank was never removed from the site. Files indicated no water supply
wells are located in the immediate area (150 feet). A copy of the NOV is contained in
Attachment A.

On October 10, 2018, Tom Lennon with Piedmont Industrial Services provided oversight of the
closure of a former 550 gallon non- regulated residential heating oil tank at 821 Coulwood
Drive in Charlotte, Mecklenburg County. A site location map is presented as Figurel. A site
map with former UST and soil sample location is provided in Figure 2. UST closure was
completed by Salem Environmental in conjunction with Zebra Environmental.
Initial efforts included the cleaning and removal of remaining tank contents with a vac -truck.
A total of 561 gallons of a #2 fuel oil/water mixture was removed from the tank with the vac -
truck. The collected residual material removed from the tank was transported and disposed of
by Zebra Environmental located in High Point, North Carolina (see Attachment B). Upon
removal of the tank, it was noted that the top portion of the UST fill pipe was missing and the
tank was full of oil/water mixture. In addition, rust holes were noted on the base of the tank
once removed. The subject tank was transported off site for proper disposal. A certificate of
disposal for the tank provided by Salem Environmental is provided (Attachment B). No
petroleum impacted soils were removed from the site.
Following completion of the removal activities, one soil sample (S-1-6') was collect from the
base of the UST excavation at a depth of approximately 6 feet below surface grade. The soil
sample was collected from the UST excavation by having the track hoe lift undisturbed soil
from the floor of the excavation to the surface where the soil sample was collected by
Piedmont Industrial personnel. A new pair of latex sample gloves was worn during sample
collection and the collected sample was place in laboratory prepared containers. The
collected sample exhibited a distinct petroleum odor indicative of contamination. The
collected sample was placed on ice and transported to Prism Laboratories (NC Certification #
402) in Charlotte, North Carolina. The collected soil sample were analyzed by EPA method
8015C 3 for TPH-DRO and by TPH-GRO. As indicated in the laboratory test report
(Attachment Q, sample 5-1-6' exhibited a TPH-GRO concentration of 140 ppm and a TPH-
DRO concentration of 16,000 ppm. Detected concentrations exceed. NCDEQ cleanup levels
for unrestricted use.
Recommendations:
On October 10, 2018, Tom Lennon with Piedmont Industrial Services provided oversight of the
closure of a former 550 gallon non- regulated residential heating oil tank at 821 Coulwood
Drive in Charlotte, Mecklenburg County.UST closure was completed by Salem Environmental
in conjunction with Zebra Environmental. As indicated above, soil contamination in excess of
NCDEQ action levels for unrestricted use still remain on site.
Session Law 2015-286 was established to expand the risk -based framework. In addition, as a
result of this legislation, the NCDEQ in general, no longer requires clean up of a release from
residential non -regulated heating oil tanks. Based on this change, no additional assessment or
remediation soil should be required by the NCDEQ. Piedmont recommends that a Notice of
Residual Petroleum (NORP) restricting the use of soil (affected area) and groundwater on the
site be prepared and placed on the subject property deed. Pursuant to NC law, the property
should not be sold prior to the NORP being place on the property deed or the site being
remediated to unrestricted standards. A request for No Further Action pending placement of a
NORP on the property deed is recommended to be requested from the NCDEQ.

Dear Mr. and Mrs. Digiampaolo:
In accordance with North Carolina Session Law 2015-241, Section 14.1613(b)(1), the Department shall not
require a responsible party to take immediate action or initial abatement actions with respect to a discharge or
release from a noncommercial underground storage tank until such time as the Department has classified the risk
posed by the discharge or release, except for those actions determined by the Department to be necessary to protect
public health, safety, and welfare and the environment, and to mitigate any fire, explosion, or vapor hazard.
Due to the possibility that free product may be present in the soil or on the ground surface and due to the
presence of strong petroleum odors caused by the petroleum release from an underground storage tank at the
subject address, your site is being classified as high risk. Therefore, you are required to take, or continue to take,
immediate actions within seven days from the date of this letter to mitigate possible hazards. Specifically, you
shall mitigate free product and petroleum saturated soils on the ground surface or develop and enact an alternative
remedial strategy that otherwise mitigates the specific risk factors posed by the condition described above, with the
approval of the Regional Office. Furthermore, report in writing to my attention at the Mooresville Regional Office
the actions taken to mitigate the hazards mentioned above within 7 days of the date of this Notice.

Information received by this office of the UST Section, Division of Waste Management, on June 9, 2017
confirms a release or discharge from a petroleum underground storage tank (UST) system at the above -referenced
location. Records indicate that you are the owner or operator of this UST system. This letter explains the
violation(s) and associated corrective action(s) you must take as a result of the release or discharge in accordance
with North Carolina statutes and rules. The UST Section, Division of Waste Management, administers the state's
rules for USTs and the required response for petroleum releases. Those rules are located in Title 15A, Subchapter
2L and Title 15A, Subchapter 2N of the North Carolina Administrative Code (NCAC).
VIOLATION l:
Failure to mitigate hazards caused by a release of free product onto the subject property, as requested in the July 6,
2017 Notice of Regulatory Requirements.
REQUIRED CORRECTIVE ACTION:
Therefore, you are required to take, or continue to take, immediate actions within seven days from the date of this
letter to mitigate possible hazards. Specifically, you shall excavate free product impacted soils on the ground
surface, or develop and enact an alternative remedial strategy that otherwise mitigates the specific risk factors
posed by the condition described above, with the approval of the Regional Office. Please note that actions are also
required to address free product impacted soils on the downgradient adjacent property (831 Coulwood Drive).
Furthermore, submit a report to the UST Section, Mooresville Regional Office to detail the actions taken to
mitigate the hazards mentioned above within 7 days of the date of this Notice.

It's my understanding that the neighbor's property may of had some soil cleanup conducted, do you know if any soil

I have attached the soil report that was sent my way just a week or two ago from C.E.R.T. From what I can tell, there
aren't any wells within 150 feet of 821 Coulwood (highlighted in red below). There is one well in that neighborhood but
its more the 150 feet off of Kimmswick Road (red dot). I have also attached an image that shows the area that was
cleaned up in blue and the contaminated areas in red. Let me know if you need any other information!

Ashley could you please forward along any information you might have in regards to this issue. I purchased
the property 2 months ago and this is the first I have heard about any issues, especially of this caliber. I have
looked over the documents and it mentioned you had pictures pertaining to this incident. That would be very
helpful in locating the tank that was the origin of the spill.
I'm starting to process all this new information and get an idea of how to move forward properly to ensure
we handle things correctly.

Below you will find some general information about home heating oil underground storage tanks:
Home heating oil underground storage tanks are not and haven't been regulated in the state of North
Carolina. The UST section only has records of those that have been reported to our agency. These reports a
generally result from notifications of contamination or tank removals at properties where parties are seeing
no further action" status. Home heating oil tanks are non -regulated, non-commercial underground storage
tanks (USTs) that are exempt from the "technical regulations" (e.g., leak detection monitoring, corrosion
protection, spill and overfill control) that apply to regulated USTs. Even though home heating oil tanks are
exempt from these technical regulations, sampling and cleanup regulations may apply if there is a leak or
spill from your tank. If there is no evidence of a release, then there is no need to report to the UST
Section. The links below provide additional information.
If a leak is discovered under the current ownership of the property, the current property owner is considered
the responsible party for clean-up. Many companies do environmental work related to underground storage
tanks. Typically, they can be found in the yellow pages of a telephone book under "Environmental
Consultants." The DWM UST Section provides a list where companies that do environmental work can
provide their information. This list is called the "UST Service Provider Listing" it is located at
http://deg.nc.gov/about/divisions/waste-management/ust/service-provider-listing. When choosing a
company, we recommend getting several estimates and references. Site assessments and cleanup work must
be conducted under the responsible charge of a licensed geologist or professional engineer.

ourselves and surrounding homeowners. We have already contacted our real estate agent and have disclosed
this information to her and we plan to handle things appropriately moving forward.
I have been in touch with Lee Shank, the original person that handled clean up at this site as well as another
company I have found to get some ideas of how to handle things moving forward.

More detailed info on a notice of residual petroleum:
If there is a release at a home heating oil tank and no water supply wells with 150 feet of the release, a
property owner can file a notice of residual petroleum for a site. The UST project manager for that county
reviews the information. If the information is approved, the UST regional supervisor will sign off on the
notice. A conditional no further action letter is issued at this time. The property owner must then file the
notice of residual petroleum with the county and send out a public notice to the surrounding properties via
certified mail. The owner then provided a copy of the filed notice to the UST section and copies of the letters
and delivery tracking to surrounding properties. The final no further action letter will be issued at this
step. The instructions and form for a Notice of Residual Petroleum can be found at the following link,
https:Hdeq.nc.,gov/about/divisions/waste-management/ust/forms. We use the alternate notice of residual
petroleum for home heating oil tanks.
Option 3 — If you would like no further action status with restrictions on the property deed, you could have
someone test surface soil for DRO and GRO in the area of the tank. If they come back above state standards
and since there are not water supply wells with 150 feet, you could file a Notice of Residual Petroleum with
Mecklenburg County. This puts deed restrictions on the property (no water supply well installations and no
digging with 3 feet of the area of contamination). With the notice of residual petroleum filed, you could then
request no further action status.
Option 4 — If you would like no ftu-ther action status with restrictions on the property deed, you could have the
heating oil tank and contaminated soil removed. A licensed geologist or professional engineer would need to
collect samples from the excavated area and have the analyzed with the following methods EPA 8260B, EPA
8270D, MADEP VPH, & MADEP EPH to meet risk based requirements for home heating oil releases. If
these come back above state standards, you could then file a notice of residual petroleum and request no
further action status.
Option 5 - If you would like a "clean closure" no further action status for this site, you could have someone
test surface soil for DRO and GRO in the area of the tank. If they come back below state standards, you
could request no further action status. If they do not come back below state standards then you would need to
remove the heating oil tank and contaminated soil. A licensed geologist or professional engineer would need
