To Whom it may concern,
You are receiving this letter and the following document due to an incident that
occurred in previous years. There was an underground tank located at 821 Coulwood Drive that
leaked onto an adjoining property in years past. While clean up of the neighbor's property was
done correctly at the time, the incident was not handled properly at 821 Coulwood Drive. This
action caused the incident to remain unsatisfactory to the DEQ's (Department of Environmental
Quality) office, and needed to be resolved. During our work there, we took action to handle the
process and are trying to resolve the issue to satisfy the DEQ's standards and close out this
incident. The attached letter will explain into further detail the situation.

The Soil Cleanup Report/ Site Closure Request received by the UST Section, Division of Waste Management,
Mooresville Regional Office on November 29, 2018 has been reviewed. The review indicates that soil contamination
exceeds the residential maximum soil contaminant concentrations (MSCCs) established in Title 15A NCAC 2L .0411.
North Carolina General Statute (NCGS) 14313-279.9 and 14313-279.11 require a Notice of Residual
Petroleum (Notice) to be filed with the Register of Deeds in Mecklenburg County, where the release is located,
when a release from an underground storage tank has not been remediated to below "unrestricted use standards".
The Notice is required either prior to conveyance of a contaminated property or prior to receiving a Notice of No
Further Action. "Unrestricted use standards" for groundwater are the groundwater quality standards and interim
standards contained in Title 15A NCAC 2L .0202, and "unrestricted use standards" for soil are the residential
maximum soil contaminant concentrations (MSCCs) established in Title 15A NCAC 2L .0411.
The Notice must be prepared in accordance with the instructions and format found in the Instructions and
Form for Notice of Residual Petroleum with Alternate Land Use Restriction available at the following link
https://deq.nc.gov/about/divisions/waste-management/ust/forms. It must contain a legal description of the
property containing the source of contamination and legal descriptions of any other properties which you own (or
control) which are contaminated by the release. The Notice must also include appropriate land use restrictions for
these properties (soil and groundwater). In addition, the Notice must identify all other properties (adjacent,
adjoining, downgradient, etc.) on which contamination is known to exist at the time the Notice is prepared.

The Notice of Residual Petroleum must be sent to this regional office of the UST Section within 30 days
of the date of this letter for approval and notarization. The approved and notarized Notice must then be filed by
you with the Register of Deeds, and a certified copy of the filed Notice must be submitted to this office within 30
days of its return to you.
The UST Section determines the subject incident to be eligible conditionally for no further action status.
However, final approval of no further action status is contingent on the filing of the approved notice of residual
petroleum with the Register of Deeds in the county in which the release is located, verified by the receipt of a
certified copy of the filed notice of residual petroleum by this office; and on receipt of confirmation that public
notice requirements have been completed, as described in the following paragraphs.
Public notice in accordance with 15A NCAC 2L .0409(b) also is required. Thus, within 30 days of
receipt of this letter, a copy of the letter must be provided by certified mail, or by posting in a prominent place, if
certified mail is impractical, to the local health director, the chief administrative officer of each political
jurisdiction in which the contamination occurs, all property owners and occupants within or contiguous to the area
containing contamination, and all property owners and occupants within or contiguous to the area where the
contamination is expected to migrate. Within 60 days of receiving this letter, this office must be provided with
proof of receipt of the copy of the letter or of refusal by the addressee to accept delivery of the copy of the letter
or with a description of the manner in which the letter was posted. Interested parties may examine the Soil
Cleanup Report/ Site Closure Request by contacting this regional office and may submit comments on the site to
the regional office at the address or telephone number listed below.
This conditional No Further Action determination will not become valid until the UST Section
receives a certified copy of the Notice of Residual Petroleum which is filed with the Register of
Deeds and until public notice requirements are completed.

contains residual petroleum and is an Underground Storage Tank (UST) incident under North
Carolina's Statutes and Regulations, which consist of N.C.G.S. 143-215.94 and regulations adapted

the remedies provided by law or by means of a civil action, and may also be enforced by any unit of local
government having jurisdiction over any part of the Site. Any attempt to cancel this Notice without the
approval of DEQ (or its successor in function) shall be subject to enforcement by DEQ to the full extent
of the law. Failure by any party required or authorized to enforce any of the above restriction(s) shall in
no event be deemed a waiver of the right to do so thereafter as to the same violation or as to one occurring
prior or subsequent thereto.

Or is that something that can be scan/sent over via email? Per the February 2018 submittal policies, we
require a paper and electronic copy. You can email the electronic copy instead of submitting a cd copy,
but I will still need a paper copy for the physical file.

15A NCAC 02L .0409 NOTIFICATION REQUIREMENTS (on page 27)
(a) A responsible party who submits a corrective action plan which proposes natural attenuation or to cleanup groundwater
contamination to a standard other than a standard or interim standard established in 15A NCAC 02L .0202, or to cleanup soil
other than to the standard for residential use or soil -to -groundwater contaminant concentration established pursuant to this
Section, whichever is lowest, shall give notice to: the local Health Director and the chief administrative officer of each
political jurisdiction in which the contamination occurs; all property owners and occupants within or contiguous to the area
containing the contamination; and all property owners and occupants within or contiguous to the area where the
contamination is expected to migrate. Such notice shall describe the nature of the plan and the reasons supporting it.
Notification shall be made by certified mail concurrent with the submittal of the corrective action plan. Approval of the
corrective action plan by the Department shall be postponed for a period of 30 days following receipt of the request so that the
Department may consider comments submitted. The responsible party shall, within a time frame determined by the
Department to be sufficient, provide the Department with a copy of the notice and proof of receipt of each required notice, or
of refusal by the addressee to accept delivery of a required notice. If notice by certified mail to occupants under this Paragraph
is impractical, the responsible party may give notice by posting such notice prominently in a manner designed to give actual
notice to the occupants. If notice is made to occupants by posting, the responsible party shall provide the Department with a
copy of the posted notice and a description of the manner in which such posted notice was given.
(b) A responsible party who receives a notice pursuant to 15A NCAC 02L .0407(d) of this Section for a discharge or release
which has not been remediated to the groundwater standards or interim standards established in Rule .0202 of this Subchapter
or to the lower of the residential or soil -to -groundwater contaminant concentrations established under 15A NCAC 02L .0411
of this Section, shall, within 30 days of the receipt of such notice, provide a copy of the notice to: the local Health Director

Hey Trudy, I wanted to update you on our current state of the process. I went and had the deed recorded
today and have my certified copy in hand. But our buyers are requiring us to get the NFA letter in hand
before they will close on the home.
So my question to you now is how soon do you think we could realistically get that NFA letter? I have
all the certified letters sent out and they are scheduled for delivery by tomorrow, according to the
tracking numbers. I remember you mentioning that if we showed/proved the effort to get those letters out
to the appropriate people that we could possibly receive the NFA letter without having the green cards in
hand. Wanted to see if there might be another way to go about satisfying my duty to the DEQ that we
could possibly pursue to help speed things along and allow us to close out this property.
As always I greatly appreciate your help in resolving this matter.

INSTRUCTIONS FOR PREPARING A 'NOTICE OF RESIDUAL PETROLEUM' REFERENCING
ALTERNATE LAND USE RESTRICTIONS (FOR EXISTING RESIDENCES ONLY) FOR FILING
The following is a list of instructions to assist in the preparation and filing of a Notice of Residual
Petroleum
1. The Notice shall be prepared in accordance with the format provided in these instructions and shall
include reference to the appropriate alternate land use restrictions. (REWORDING OF THE NOTICE IS
NOT RECOMMENDED AND WILL SUBSTANTiALL Y DELA YAPPRO VAL.)
2. The Notice shall include a description that would be sufficient as a description in an instrument of
conveyance of the (i) real property on which the source of contamination is located and (ii) any real
property on which contamination is located at the time the remedial action plan is approved and that was
owned or controlled by any owner or operator of the underground storage tank or other responsible party
at the time the discharge or release of petroleum is discovered or reported or at any time thereafter.
3. The Notice shall also identify the location (legal description) of any residual petroleum on other real
property on which contamination is known to exist at the time the Notice is prepared and that is a result of
the release.
4. The Notice shall reference any restrictions on the current or future use of the real property that are
imposed by the Secretary to protect public health, the environment, or users of the property.
5. (IF REQUIRED BYDEPARTMENT OF ENVIRONMENTAL QUALITY.) If the contamination is
located on more than one parcel or tract of land, the Department may require that the owner, operator, or
other person responsible for the discharge or release prepare a composite map or plat that shows all
parcels or tracts.
If the contamination is located on one parcel or tract of land, the owner, operator, or other person
responsible for the discharge or release may prepare a map or plat that delineates the contamination but is
not required to do so.
When the Department has approved a map or plat, it shall be recorded in. the office of the register of
deeds and shall be incorporated into the Notice by reference.
Any map or plat shall be prepared and certified by a professional land surveyor, shall meet the
requirements of G.S. 47-30 and any requirements of the county Register of Deeds, and shall be submitted
to the Department for approval. The plat shall include: (ALL CONTENTS OF THE PLAT MUST BE
DRA WN IN INDELIBLE INK)
a. Property lines, north arrow, scale, bearings and distances as appearing on the deed;
With respect to permanently surveyed benchmarks, location and dimensions of areas of the
property where contamination is known to exist in
® groundwater at a concentration exceeding the standard or interim standard established in 15A
NCAC 2L .0202 and/or
® soil at a concentration exceeding the residential maximum soil contaminant concentration
established in 15A NCAC 2L .0411.
c. The printed name(s) and title(s) and properly notarized signature(s) of individual(s) with authority
to legally bind the responsible party(ies) (i.e., responsible party(ies), an individual with power of
attorney for the responsible party(ies), officer of a corporation, etc.) (PRINTED TEXT,
SIGNATURES, AND NOTAR YSEALS, AS WITH ALL MARKINGS ON THE PLAT, MUST
