Dear Mr. Hall:
On December 6, 2018, Connie S. Wylie, representing the State of North Carolina, Division of
Waste Management Solid Waste Section, inspected the above referenced facility for compliance
with North Carolina solid waste statutes and rules and in regards to a Notice of Deficiency that
was issued on 10/19/2018. You were present and represented We Pump It during this follow up
inspection. The following violation was noted:
A. G.S. 130A‐291.1(d) Septage shall be treated and disposed only at a wastewater
system that has been approved by the Department under rules adopted by the
Commission or at a site that is permitted by the Department under this section.
Per 15A NCAC 13B .0831(15) “Septage” means septage as defined in G.S. 130A‐
290(a)(32) and also shall include washings from the interior of septage handling
containers, including pumper trucks.
I observed that the two truck cleanout areas had not been cleaned up properly as per
the Notice of Deficiency issued on 10/19/2018. Mr. Hall stated that he had not fully
read the Notice of Deficiency and was unaware that he needed to clean up the areas.
Reviewed the NOD letter with Mr. Hall & discussed cleanup procedures.

Based upon the foregoing, We Pump It shall come into compliance by December 31, 2018 with
all the requirements of the regulations of G.S. 130A‐291.1(d) by completing the following.
1. All septage debris & contaminated soil shall be completely removed from the two truck
cleanout areas and disposed of properly at a Municipal Solid Waste Landfill. Provide
this office with the disposal tickets from the landfill.
2. Submit to this office a copy of the truck pumping logs for this permitted firm for the last
six months.
3. No septage residuals (such as rinse water, paper/plastic trash or contaminated grit)
from the washings of the interior of the septage truck tanks shall be sprayed or placed
on the ground surface. Any rinse water from the septage truck tanks shall be properly
disposed of at the approved wastewater treatment plant per the septage management
firm permit. Any septage debris (paper or plastic) and contaminated grit from the
cleanout of the septage truck tank shall be contained off the ground surface and
disposed of properly at a municipal solid waste landfill.
4. We Pump It shall provide a written certification with supporting documentation on
company letterhead confirming the noted compliance schedule has been completed.
Include in this certification any actions taken to prevent these violations from occurring
in the future. Mail this certification to Connie S. Wylie, Division of Waste Management,
Fayetteville Regional Office, 225 Green Street, Suite 714, Fayetteville, NC 28301 by
December 31, 2018.
The violation listed above was observed by Section staff and requires action on behalf of the
facility in order to come into or maintain compliance with the Statutes, Rules, and/or other
regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A‐22,
an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid
Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the
N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management
facility or a solid waste collection service and any such further relief as may be necessary to
achieve compliance with the North Carolina Solid Waste Management Act and Rules.

Please keep me informed of your progress in this matter. Solid Waste Section staff will conduct
a follow‐up inspection to verify that the facility has completed the requirements of this Notice of
Violation.
