STATUS OF PAST NOTED VIOLATIONS:
G.S. 130A-291.1(d) The two truck cleanout areas (where septage debris was noted on the ground surface) have not
been cleaned up per the Notice of Deficiency issued 10/19/2018.
OBSERVED VIOLATIONS:
G.S. 130A-291.1(d) Septage shall be treated and disposed only at a wastewater system that has been approved by
the Department under rules adopted by the Commission or at a site that is permitted by the Department under this section.
15A NCAC 13B .0831(15) “Septage” means septage as defined in G.S. 130A-290(a)(32) and also shall include
washings from the interior of septage handling containers, including pumper trucks.
No septage residuals (such as rinse water, paper/plastic trash or contaminated grit) from the washings of the
interior of the septage truck tanks shall be sprayed or stored on the ground surface. Any rinse water from the pump trucks
shall be properly disposed of at the approved wastewater treatment plant per the firm permit. Any septage debris (paper or
plastic) and contaminated grit from the cleanout of the truck tank shall be contained off the ground surface and disposed
of properly off site.
Follow up visit for the Notice of Deficiency issued 10/19/2018. I observed that the two truck cleanout areas
have not been cleaned up properly & noted scattered plastic septage debris still on the ground. Mr. Hall stated that
he had not fully read the Notice of Deficiency that he received on 10/26/2018. I instructed Mr. Hall to completely
clean up the two areas (septage debris & contaminated soil) by December 31, 2018 & to properly dispose of the
waste at a landfill. Reviewed the Notice of Deficiency letter & discussed cleanup procedures with Mr. Hall.

ADDITIONAL COMMENTS
1. Submit to this office a copy of the truck pumping logs for this permitted firm for the last six months.
2. Observed the two frac tanks again. Some water was in the two tanks but did not appear to be septage (no
sign of floating septage debris & no odor noted). Per 15A NCAC 13B .0836(a) No person, shall
establish on his land, or allow to be established on his land, a septage detention facility, unless a permit for
the facility has been obtained from the Division or the facility is operating in accordance with a NPDES
permit issued by the NC Division of Water Resources. No septage shall be stored on this site (except in
the tanks of the 2 permitted pump vehicles), regardless of the amount of waste or length of time,
unless a septage detention facility permit is issued. Please contact this office if you wish to obtain a
permit for the storage of septage.
3. No signs were noted of the land application of straight septage waste. Per the 2018 Septage Management
Firm Permit this firm is authorized to pump domestic septage and take it to the Town of Siler City WWTP
for proper disposal per G.S. 130A-291.1(d).
4. The permitted vehicles were not inspected at this time & truck logs were not reviewed.

with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
