PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: 1. RESOLVED: 15 NCAC 13B .1402(g)(3) states that small Type 1 facilities must provide, “notification of the Solid Waste Section prior to operation and on an annual basis.” No notification for the current operating year had been received by the Solid Waste Section from the City of Eden at the time of this inspection. Mr. Curry, who had recently taken over as acting Solid Waste Superintendent following the retirement of the former superintendent, stated that he had not known of the annual notification requirement. Technical assistance and contact information were provided to Mr. Curry and Mr. Dishmon during the facility records review. Mr. Curry completed and submitted the annual notification form on December 4, 2018, as required. The facility accepts brush and yard waste generated within the City of Eden. 2. The site is bisected by a gravel roadway, which is maintained in good condition. The area on the northeast side of the road is used for the unloading and storage of brush and land clearing debris. The area on the southwest side of the roadway is used for accepting and composting grass clippings and leaves. 3. Mr. Curry stated that wood waste is ground annually by a city contracted vendor. The contractor processes the wood waste onsite and removes it when processing is complete. 4. Leaves had begun to be received at the site earlier in the month. Mr. Curry explained that composting operations were in the initial stages. Several piles of material were observed on the site, and Mr. Curry stated that he would be forming them up into windrows and would begin recording temperature readings at that time. 5. The southwestern (compost) portion of the site was found to be clean, with no unacceptable materials observed. This area is sloped so that surface water drains toward the back (southwest) of the site. Mr. Curry pointed out a drainageway that runs through the middle of the compost area, and explained that he was in the process of clearing out and re-establishing the ditch. He stated that he had begun the construction of several short lines of silt fence that would serve to trap any sediment that might travel with the surface water. 6. The northeastern portion of the site held several large rows of brush and land clearing debris. Weather conditions had recently been wet, and the unloading area had been repaired with dirt and gravel to maintain all- weather access and to allow vehicles and equipment to maneuver safely. 7. Some unacceptable materials were observed in the wood waste stockpile, including a tire, several pieces of treated lumber, and a plastic wet mop. Mr. Curry photographed the materials and stated that they would be moved to the transfer station for proper disposal prior to the end of the day. He provided photographs following the inspection showing the waste that had been removed from the site. 8. Some ponding water was observed between the stockpiles of brush. Perform regular site maintenance to ensure that water does not pond in and around the wood waste stockpiles. 9. It is recommended that a storage plan be developed for the wood waste stockpiles that incorporates fire lanes and ensures adequate access to all areas in case of emergency. With this plan, wood waste can be positioned correctly as it is accepted at the facility. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Wood waste is staged in a haphazard manner on the northeast side of the site.
