PURPOSE OF SITE VISIT:
Partial Inspection
STATUS OF PAST NOTED VIOLATIONS:
1. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0203(d) states: “By receiving solid waste at a
permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall
comply with the conditions of the permit.” Permit to Operate No. 2906, Attachment 1, General Permit
Conditions/Information, Part I, Item 6 states, “Operation of this solid waste management facility must be in
accordance with the Solid Waste Management Rules, 15A NCAC 13B, Article 9 of the Chapter 130A of the
North Carolina General Statutes, the conditions contained in this permit, and the approved plan.” Permit to
Operate No. 2906, Attachment 1, General Permit Conditions/Information, Part I, Item 7 states, “This permit is
issued based on the documents submitted in support of the application for permitting the facility including those
identified in the “List of Documents for the Approved Plan” which constitute the approved plan for the facility.”
Permit to Operate No. 2906, Attachment 1, General Permit Conditions/Information, Part VI, lists DIN 28787 –
Permit to Construct Application, Davidson County MSW Landfill – Phase 2, Area 3, Prepared by S+G September
2017 and revised through March 2018 as one of the documents for the Approved Plan. Section 1.12 – Record
Keeping Program, of the Operations Manual (March 2018) - Attachment E of Permit to Construct Application –
FACILITY COMPLIANCE INSPECTION REPORT

lists all records that will be maintained in an operating record at the facility. Mr. Brushwood has reported that
county staff are continuing to work to compile the facility’s operating record and maintain it in a location at the
facility that is accessible for review as needed. Please notify the Solid Waste Section as soon as the operating
record has been assembled at the facility.
OBSERVED VIOLATIONS:
No new violations observed.
ADDITIONAL COMMENTS
1. This meeting was scheduled to reinspect the new Phase 2 - Area 3 - Cell 1. During the pre-operations inspection
conducted on November 1, 2018, erosion rills were observed on the interior slopes of the new cell and water
had ponded in the northwest end of the cell. The damage was due to the heavy rains and severe weather during
the month of October.
2. During this inspection, the interior slopes of the new cell were found to have been repaired, and much of the
slope area had new vegetation in place. Areas where additional erosion had occurred had been repaired, and
clean soil appeared to have been tracked in to stabilize these slopes.
3. A large pump was in operation at the time of this inspection, and water was being pumped out in a 4” line
directly to the storm drain.
4. Some ponding water was observed in the northwest end of the new cell.
5. Mr. Brushwood explained that he would begin filling on the southern end of the middle section of the new cell,
expanding to the northwest end and removing any remaining water before depositing waste. He added that he
would maintain the current working face in the active cell, but would direct fluff loads to the new cell until the
liner was adequately covered with soft waste material. He stated that his goal was to protect the liner system
from damage by disposal operations.
6. Slopes on the active area of the landfill appeared to be fairly well stabilized after the continuing heavy rains
experienced in the area. Mr. Brushwood pointed out several areas on the northern slopes that were still
undergoing repair work.
7. The working face appeared to be small and well-controlled. Access to the tipping area is currently limited to
single vehicles, due to the tight operating area remaining on the top of the landfill.
8. The operating area around the working face was well covered, and no waste was visible as operations were
taking place.
9. Windblown litter was very minimal at the facility, and trash bags were observed at several points where clean-
up crews had been operating earlier in the morning.
10. Leachate hauling from the storage pond had resumed after the long holiday weekend, and approximately 1’ of
freeboard was evident. Mr. Brushwood stated that he hoped to have the pond drawn down again within the next
few days, indicating that hauling would occur 6 days per week until he was satisfied with the level. The leachate
storage tank on the active side of the landfill was observed to be well below the halfway point.
11. Some sediment was observed in the perimeter ditch that follows the toe of the active landfill slope. Mr.
Brushwood stated that he intends to clean the ditches out again when a break in the weather makes it possible to
do so.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
