Mr. Bivins: Please send the Solid Waste Section the hard copy of the FA documents including the approved cost estimates and FA mechanism/certified financial statement (a combination of cash deposits, insurance, and binding loan commitments from a financial institution licensed to do business in the State and rated AAA by Standard & Poor's, Moody's Investor Service, or Fitch, Inc.) covering the FA amount of $107,500 dollars. (CEC) presents this opinion of probable cost for third-party removal of waste and restoring the GBUSA transfer station (the Facility). This estimate was prepared in support of a financial assurance, as required by the NC DENR Solid Waste Section (SWS), based on the permitted maximum tonnage of 500 tons per day (tpd). Legislation enacted in 2007 requires all solid waste facilities to post a financial assurance instrument (surety bond, insurance policy, irrevocable letter of credit, cash deposit). This instrument guarantees the availability of funds to be used by the Solid Waste Section (SWS) for third-party debris removal and facility clean up, in the event that the facility is forced into early closure. Factors that could potentially force early closure include, but are not limited to, insolvency or substantial non-compliance, including multiple violations and/or storage of more materials on the premises than is allowed by the permit or is covered by the financial assurance instrument. SWS requires a calculation of the maximum volume and tonnage anticipated to be stored on the premises at any given time, including the recyclables and 5 days of the incoming waste stream. The following bond amount is calculated based on estimated tonnage and an estimated third-party cost of $100 per ton for removal and off-site disposal. Pursuant to this requirement, I have evaluated costs for third-party loading, hauling, and disposal based on unit costs for the Material Reclamation (located on Westwood Industrial Dr.), assuming a maximum waste load of 2,500 tons: One week Maximum Waste Tonnage: 2,500 tons Estimated Disposal Unit Cost: $25 per ton Loading and Hauling Unit Cost: $14 per ton Total Unit Cost: $39 per ton Lump Sum Cleanup Cost: $10,000 Total Financial Assurance Required: $107,500 The cost estimate for the financial instrument must be updated annually. There should be no post-closure monitoring or other requirements associated with the facility.
