CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Permit to Operate No. 2906, Attachment 1, General Permit Conditions/Information, Part I, Item 6 states, “Operation of this solid waste management facility must be in accordance with the Solid Waste Management Rules, 15A NCAC 13B, Article 9 of the Chapter 130A of the North Carolina General Statutes, the conditions contained in this permit, and the approved plan.” Permit to Operate No. 2906, Attachment 1, General Permit Conditions/Information, Part I, Item 7 states, “This permit is issued based on the documents submitted in support of the application for permitting the facility including those identified in the “List of Documents for the Approved Plan” which constitute the approved plan for the facility.” Permit to Operate No. 2906, Attachment 1, General Permit Conditions/Information, Part VI, lists DIN 28787 – FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 Permit to Construct Application, Davidson County MSW Landfill – Phase 2, Area 3, Prepared by S+G September 2017 and revised through March 2018 as one of the documents for the Approved Plan. Section 1.12 – Record Keeping Program, of the Operations Manual (March 2018) - Attachment E of Permit to Construct Application – lists all records that will be maintained in an operating record at the facility. Mr. Brushwood has reported that county staff are working to compile the facility’s operating record and maintain it in a location at the facility that is accessible for review as needed. Please notify the Solid Waste Section as soon as the operating record has been assembled at the facility. OBSERVED VIOLATIONS: No new violations observed. ADDITIONAL COMMENTS 1. This meeting was scheduled to conduct a pre-operations inspection of the new Phase 2 - Area 3 - Cell 1. 2. A pre-inspection meeting was held at the double-wide office onsite to review the CQA report and required records. 3. Mr. Chao stated that the financial assurance documentation must be provided for review prior to the Permit to Operate being issued. Mr. Scheer stated that he would work with the county to produce the financial assurance documentation required. 4. A haul road, leading directly from the scale house to the new cell, was observed to be of all-weather construction and in good condition. Mr. Brushwood stated that he intends to build a secondary haul road that will take working face traffic on a longer approach/exit route during wet weather. He explained that using an alternate haul road on bad weather days would help eliminate mud being tracked off the facility and onto the public roadway. 5. Erosion control devices had been installed around the new cell and appeared to be functioning properly. Ditch lines and catch basins had been stabilized with matting and were observed to be in good condition. 6. Edge-of-waste markers were observed to be in place around the new cell, as required. 7. The new cell had been prepared for October’s hurricane and tropical storm, and the county had been pumping to remove water that had ponded along the northwest side. Mr. Brushwood stated that the county has rented a large pump to finish the job prior to starting the first lift. 8. The side slopes of the new cell had been damaged by heavy rains and severe weather during the month of October. Erosion rills were apparent in most areas, although they appeared to be shallow. Please make repairs to the new cell to eliminate erosion rills and stabilize the side slopes; and, notify the Solid Waste Section upon completion of the repairs. 9. Mr. Chao observed that the rain cover in place on top of the leachate collection pipes on the bottom of the new cell must be removed prior to adding waste on top of the pipes. Mr. Brushwood stated that the rain cover would be pulled back as disposal operations approach the pipes. 10. Mr. Scheer and Mr. Brushwood outlined their plan to begin landfilling in the center area of the new cell and to work outward toward the northeastern and southwestern sides from there. 11. Mr. Brushwood emphasized that the initial lift will be made up only of fluff loads, to ensure that the liner is not damaged by disposal operations. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Erosion rills are evident on all of the side slopes in the new cell. Ponding water can be seen along the northwest end of the new cell. Note the pump and hose running along the slope at right. Drainage ditch lines have been stabilized with matting and appear to be functional.
