STATUS OF PAST NOTED VIOLATIONS:
.0838(c)(1) No recent application to be checked for pH during this visit. The hay was harvested & removed and the
access road repaired. A statement was received from Mr. Locklear regarding corrective actions taken for the Notice of
Violation issued August 6, 2018. The Notice of Violation is resolved.
OBSERVED VIOLATIONS:
1. .0835(g) Applications for renewal permits shall be submitted to the Division at least 90 days prior to the
expiration date of a permit. This permit expires on January 1, 2019. A notification letter was sent to the permit
holder on September 4, 2018. As of this date (less than 60 days prior to the expiration date) a renewal
application has not been received by this office.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The fields have been harvested. Hay bales are sitting on Field 2 and need to be removed (including any
loose hay) before land application may occur on this field. An adequate rye cover crop shall be established
on the disposal fields for land application to occur this winter.
2. No sign of heavy or recent application. No odors noted.
3. The access road needs maintenance. The required signs are posted at the site entrance.
4. The cropstand appears to be improved - less weeds & thin patches appear to be on site.
5. The field markers appear accurate however excess vegetation needs to be cut back from some of the posts – the
10 foot setback along the treeline on Field 2 needs to be reestablished.
6. No sign of land application outside the permitted boundaries. It appears the approved setbacks are being met.
7. Soil samples shall be taken by the permit holder & submitted for analysis.
