Septage spills noted on the ground surface at the pump, on the left side of the frac tank and at a hose laying on the ground on the left side of the facility. Mr. Carter stated that there had been issues with a pump & that work was underway to correct the situation. Per Permit Condition 2 “Leaks and spills are the responsibility of the Permittee and shall be immediately contained, cleaned up, and treated to prevent any contamination of the surrounding area. Any solids from leaks or spills shall be disposed of in a manner consistent with the NC Solid Waste Management Rules”. Review procedures & implement any needed changes to prevent spills from occurring – particularly in regards to hoses. Immediately clean up all septage waste & contaminated soil from the spill areas. The dumpster for screening debris has been relocated to the right side of the frac tank along the woodline. No issues or leakage noted. No apparent vectors or odors noted during this visit. 2. The two tanks appear structurally sound. 3. The required signs are posted and the access road is adequate. 4. The approved setbacks are being met. 5. The required 5 foot cleared radius (free of excess vegetation or debris) is present around the tanks. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
