Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. The winter cover crop has been planted but is not up yet. Land application shall occur this winter only if an adequate rye crop is established. 2. Some field markers are leaning or cut – Mr. Carter stated that he would repair the posts as needed. Setbacks were not measured at this time - ensure the required setbacks are present, 50 feet from property line, 200 feet to creek and 5 feet from treeline. 3. No sign of land application outside the permitted boundaries. It appears that the approved setbacks are being met. 4. No sign of recent or heavy application. No odors noted. 5. The required signs are posted and the access road is adequate. 6. Hay bales along the perimeter of the site need to be removed in a timely fashion. 7. Soil samples have not yet been taken.
