OBSERVED VIOLATIONS None. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS Carolina Power & Light Company d/b/a Progress Energy Carolinas, Roxboro Steam Electronic Plant, completed construction of the structural fill project in early 2007. The Roxboro Plant Flue Gas Desulphurization (Gypsum) Storage Pad structural fill is located on the facility property, approximately 2,000 feet east of the Roxboro Steam Plant. 1. On November 7, 2005 the Solid Waste Section received the written structural fill notification from Progress Energy Service Company, LLC. The projected timeline for construction of the Roxboro Plant Gypsum Storage Pad structural fill was December 15, 2005 to March 15, 2006. The stated purpose of the structural fill is structural fill underneath select portions of a proposed 20 acre storage pad used for storing FGD gypsum prior to reuse. 2. According to the “Notification for Recordation of Structural Fill”, dated November 27, 2007, 131,319 cubic yards or 131,319 tons of coal combustion by-products (specifically dry ash) were used in the project. 3. Per the requirements of 15A NCAC 13B .1707, the structural fill has been recorded on the property deed in Book 654 Page 242. The deed recordation occurred October 26, 2007. 4. The Gypsum Storage Pad was being well maintained at the time of the inspection. No erosion or ponded water was observed during the inspection. 5. The structural fill is currently being used for the purpose stated in the Notification. In the future if the structural fill is no longer utilized for its intended purpose as a Gypsum Storage Pad, per the requirements of 15A NCAC 13B .1705(j), the structural fill shall be covered with a minimum of 12-inches compacted earth and an additional 6-inches of surface soil capable of supporting native vegetation. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
