FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS The engineered structural fill was built in accordance with NCAC 13B .1700. The fill utilizes approximately 40,000 cubic yards of coal as excavated from the land designated to become the Piedmont Triad Research Park. Based on historical records of the Research Park property, the source of the ash was believed to be from the former Manufactured Gas Plant which operated from 1900-1960 along Third and Fourth Streets in downtown Winston-Salem. 1) The site is addressed as 2000 Lowery Street and is owned by the City of Winston-Salem 2) The structural fill is divided into two portions; an “Upper Terrace” and a “Lower Terrace” with a power line easement running north-south between them. The upper terrace has a gravel parking area on top which will be used primarily for the periodic storage of city owned equipment such as leaf collection equipment or construction materials. 3) The area within the power line easement was not disturbed during the placement of the ash. 4) The encapsulation of the fly ash with a small quantity of bottom ash used in the project was completed in August 2013. The geo-fabric cap was completed shortly afterward. The facility is covered with a minimum of 12-inches compacted earth and an additional 6-inches of surface soil capable of supporting native vegetation as per 15A NCAC 13B .1705(j). 5) No evidence of erosion was observed during the site inspection. Slope drains have been installed to minimize erosion from storm events. The side slopes were well vegetated and do not have a slope greater than a 3:1 ratio as per 15A NCAC 13B .1705(l). City staff inspect the site on a monthly basis for erosion or other maintenance concerns. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The lower terrace is accessed from a gravel drive west of the main gate; this drive is secured with a locked gate. The slopes are well vegetated (Upper Terrace).
