SUBJECT: Notice of Deficiency
Compliance Inspection Report
We Pump It
NCS‐01036
Chatham County
Dear Mr. Hall:
On October 10, 2018, Connie S. Wylie, representing the State of North Carolina, Division of Waste
Management Solid Waste Section, inspected the above referenced facility for compliance with
North Carolina solid waste statutes and rules. You were present and represented We Pump It
during this inspection. The following violation was noted:
A. G.S. 130A‐291.1(d) Septage shall be treated and disposed only at a wastewater
system that has been approved by the Department under rules adopted by the
Commission or at a site that is permitted by the Department under this section.
Mr. Hall stated that he had been cleaning out his pump truck on site to remove car
wash grit, however septage residuals were still present in the tank. I observed two
cleanout areas and noted scattered plastic septage debris on the ground. Mr. Hall
also stated that he had sprayed the rinse waster on his property in different areas.
Per 15A NCAC 13B .0831(15) “Septage” means septage as defined in G.S. 130A‐
290(a)(32) and also shall include washings from the interior of septage handling
containers, including pumper trucks.

The above violation may have or can compromise the facility’s ability to ensure protection of the
public health and the environment and thus requires remedial action on behalf of the facility in
order to maintain compliance with G.S. 130A‐291.1(d). In order to resolve these issues, We Pump
It, must take the following actions.
1. No septage residuals (such as rinse water, paper/plastic trash or contaminated grit)
from the washings of the interior of the septage truck tanks shall be sprayed or placed
on the ground surface.
2. Any rinse water from the septage truck tanks shall be properly disposed of at the
approved wastewater treatment plant per the septage management firm permit.
3. Any septage debris (paper or plastic) and contaminated grit from the cleanout of the
septage truck tank shall be contained off the ground surface and disposed of properly
off site. Immediately remove any septage debris currently on the ground surface at the
two cleanout areas.
The violation listed above was observed by Section staff and requires action on behalf of the
facility in order to come into or maintain compliance with the Statutes, Rules, and/or other
regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A‐22,
an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid
Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the
N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management
facility or a solid waste collection service and any such further relief as may be necessary to
achieve compliance with the North Carolina Solid Waste Management Act and Rules.
Please keep me informed of your progress in this matter. Solid Waste Section staff will conduct
a follow‐up inspection to verify that the facility has completed the requirements of this Notice of
Deficiency. If you have any questions please contact me at (910) 433‐3353 or e‐mail
connie.wylie@ncdenr.gov.
Sincerely,
Connie S. Wylie
