No sign of recent grease burns due to inadequately diluted grease septage. Enviro Choice provided a written certification regarding the violations & has implemented procedural changes and additional staff training to prevent violations. The Notice of Violation issued September 7, 2018 for permit #SLAS 78-22 is resolved. OBSERVED VIOLATIONS: N/A SEE BACK OF PAGE The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. Reviewed the required setbacks for this site and measured various areas. It did not appear that the required 50’ setback was present on the north side of Field 2 (this line was recently surveyed). Markers were adjusted while on site. It also appears that possibly the 50’ setback may not be fully present along the west side of Field 5. Discussed this with Matthew Markus before leaving the site who indicated that this would be reviewed. Per Rule .0837(d)(15) “Accurate property line locations are the responsibility of the site operator”. If needed adjust posts on Field 5 to ensure that the required setbacks are present. 2. The cropstand on the previous grease burn areas has significantly improved. The winter cover crop will be planted in the near future after the last harvest. Land application shall occur this winter only if a cover crop is established that is sufficient for land application to occur. 3. Was informed that all grease septage is processed thru the dewatering box, but some domestic septage is land applied directly (after lime stabilization to pH 12). Noted a heavy grayish application path on field 5 and also on Field 1 – these matted areas need to be raked loose to prevent crop damage (staff began doing this while I was on site) & implement any needed changes to prevent this from occurring. 4. Reviewed the permit submittal. Discussed minor changes needed to the application form. A copy of the nutrient management plan with a new signature/date is needed. Also need waste analysis reports for the 2nd & 3rd quarters of 2018. Received from Eric Locklear a copy of the 2018 certification for the Land Residuals class. The continuing education hours (for the firm/SLAS permits) still need to be obtained for 2018 – Mr. Locklear indicated that the Raleigh class in December would be attended. Site logs are under review. 5. A new site map is required to reflect the reduced acreage & gallons on Field 5. It was noted during this visit that an area between Fields 2 & 3 is being used for vehicles/equipment so the map will need to be adjusted for this also. 6. The required signs are posted and the access road is adequate. Was informed of the code for the new combination lock on the gate. Access to the site is being controlled for security reasons. Hay bales are currently sitting on the perimeter of Field 5 but will be removed soon. 7. Discussed the odor complaints that have been received by this office. No significant odors or vectors noted during this visit. 8. Soil samples will be taken by the permit holder in the near future. 9. Thank you for your time.
