Part I: General Facility 1. This permit is issued by the North Carolina Department of Environmental Quality, Division of Waste Management, Solid Waste Section (Section). In accordance with North Carolina Solid Waste Management Rule (Rule) 15A NCAC 13B .0201(d), a solid
waste management facility permit shall have two parts: a permit approval to construct
(PTC) and a permit approval to operate (PTO). The PTC must be implemented in accordance with Attachment 2 of this permit. The PTO must be implemented in accordance with Attachment 3 of this permit.
2. The persons to whom this permit is issued (“permittee”) are the owners and operators of
the solid waste management facility. 3. This permit shall not be effective until the certified copy of this permit which references legal descriptions for all land within the solid waste management facility boundary is
recorded in the Register of Deeds office and indexed in the grantor index under the name
of the owner of the land in the county or counties in which the land is located. The certified copy of the permit affixed with the Register's seal and the date, book, and page number of recording must be returned to the Solid Waste Section within thirty (30) calendar days of issuance of this permit. If the Solid Waste Section does not receive the
certified copy of the recorded permit within 30 calendar days of issuance of the permit,
then and in that event, the permit is suspended and of no effect until the date the Solid Waste Section receives the certified copy of the recorded permit. 4. When this property is sold, leased, conveyed, or transferred in any manner, the deed or
other instrument of transfer shall contain in the description section in no smaller type than
that used in the body of the deed or instrument, a statement that the property has been used as a solid waste management facility and a reference by book and page to the recordation of the permit.
5. By receiving waste at the facility, the permittee shall be considered to have accepted the
terms and conditions of this permit in accordance with Rule 15A NCAC 13B .0203(d). 6. Construction or operation of this solid waste management facility shall be in accordance with the North Carolina Solid Waste Management Rules, 15A NCAC 13B, Article 9 of
the Chapter 130A of the North Carolina General Statutes (N.C.G.S. 130A-290, et seq.);
the conditions contained in this permit; and the approved plan. Should the approved plan

and the rules conflict, the Solid Waste Management Rules shall take precedence unless specifically addressed by permit condition. Failure to comply may result in compliance
action or permit revocation.
7. This permit is issued based on the documents submitted in support of the application for permitting the facility including those identified in Attachment 1, “List of Documents for Approved Plan,” and which constitute the approved plan for the facility. Where
discrepancies exist, the most recent submittals and the conditions of permit shall govern.
8. This permit may be transferred only with the approval of the Section, through the issuance of a new or substantially amended permit in accordance with applicable statutes and rules.
9. In accordance with N.C.G.S. 130A-295.2(g) the permittee must notify the Section thirty (30) days prior to any significant change in the identity or business structure of either the owner or the operator, including but not limited to a proposed transfer of ownership of the facility or a change in the parent company of the owner or a change in the operator of
the facility or parent company of the operator.
10. The permittee is responsible for obtaining all permits and approvals necessary for the development of this project including, but not limited to, approval from appropriate agencies for a General or Individual National Pollutant Discharge Elimination System
Stormwater Discharge Permit, if applicable and a sedimentation and erosion control
permit. Issuance of this permit does not remove the permittee’s responsibilities for compliance with any other local, state or federal rule, regulation or statute. PROPERTIES APPROVED FOR THE SOLID WASTE MANAGEMENT FACILITY

Permitting History
This Facility registered with Department of the Secretary of State on October 26, 1992 as Todco, Inc. and began waste operations on October 26, 1992. On April 29, 2004, the facility received a permit to operate a Land Clearing Debris Treatment and Processing (T&P) and Type 1 Composting Facility under the Solid Management Permit Number 29-08.
On January 10, 2008, Davidson County issued a Conditional Use Permit for the operation of the 7.9-acre wood recycling business at the 10.45-acre facility. 2908-TRANSFER-2013, Construction and Demolition (C&D) Waste Transfer Station
Permitting History
On June 10, 2013 Todco, Inc. was permitted to operate a C&D waste transfer station and a C&D waste T&P unit, in addition to the existing wood wastes treatment and processing unit. Todco, Inc. ceased operation of Type 1 Compost Facility at the facility in 2013. The facility property expanded to 36.34 acres. Since 2013 the permit combined the C&D Waste Transfer Station
(under Solid Management Permit Number 2908-Transfer-2013) and the Treatment and
Processing Unit (under Solid Management Permit Number 2908-TP-). In 2018, pursuant to N.C.G.S. 130A-294(a3)(1), the Section issued a new permit is to Avery Dawn, LLC (landowner) and Todco, Inc. (operator) because the land property ownership was
changed and the subject facility property increased to 50.07 acres. Pursuant to N.C.G.S. 130A-
294(a2), a life-of-site (LOS) permit is issued to the C&D Waste Transfer Station (under Solid Management Permit Number 2908-Transfer-2013); but a five (5)-year term permit is issued for waste processing and treatment units (under Solid Management Permit Number 2908-TP-).

ATTACHMENT 3 CONDITIONS OF PERMIT APPROVAL TO OPERATE Part I General Facility 1. The facility shall only accept those wastes which are: a. Permitted to receive per Rules 15A NCAC 13B .0302(2) and .0402(2) and the approved plan (DIN 28819) consistent with the amended Conditional Use Permit
issued by Davidson County on September 10, 2012 (DIN 17892).
b. Generated from the service areas, approximate 50-mile radius of the facility and including the following counties: Cabarrus, Davie, Davidson, Forsyth, Guilford, Montgomery, Randolph, Rowan, and Stanly Counties.
2. The following, at a minimum, must not be accepted at the facility: hazardous waste, liquid waste, regulated medical wastes, regulated asbestos-containing wastes as defined in 40 CFR 61, and PCB wastes as defined in 40 CFR 761 and prohibited wastes listed in the approved plan (DIN 28819).
3. Pursuant to N.C.G.S. 130A-309.09A(g), the permittee must not knowingly dispose of, or accept for transfer for subsequent disposal, solid waste that is generated within the boundaries of a unit of local government that by ordinance: a. Prohibits generators or collectors of solid waste from disposing of that type or
form of solid waste.
b. Requires generators or collectors of municipal solid waste to recycle that type or form of solid waste.
4. A responsible individual trained and certified in facility operations must be on-site during
all operating hours of the facility in accordance with N.C.G.S. 130A-309.25. An attendant must be present to oversee the loading and unloading of waste. 5. The permittee must actively employ a training and screening program at the facility
prepared in accordance with N.C.G.S. 130A-295.6(g) and the approved plan (DIN 28819)
for detecting and preventing excluded or unauthorized wastes from being accept at the facility. At a minimum, the program must include: a. Random inspections of incoming loads or other comparable procedures.
b. Records of all inspections.
c. Training of personnel to recognize hazardous, liquid and other excluded waste types.
d. Development of a contingency plan to properly manage any identified hazardous,
liquid, or other excluded or unauthorized wastes. The plan must address identification, removal, storage and final disposition of these wastes.

6. The facility must be adequately secured by means of gates, chains, berms, fences, or other security measures approved by the Section to prevent unauthorized entry.
7. Signs must be posted at the entrance to the facility that state that no hazardous waste or liquid waste can be received at the facility; and provide information on dumping procedures, the hours of operation, the permit number, contact name, telephone number, and other pertinent information. Traffic signs or markers must be provided as necessary
to promote an orderly traffic pattern to and from the discharge area and to maintain
efficient operating conditions. 8. The permittee shall operate and maintain the facility in a manner to minimize odors becoming a nuisance or safety hazard according to Rule 15A NCAC 13B .0201(g) and
the approved plan (DIN 28819).
9. The permittee shall implement and apply effective vector control measures at all times to control any potential vectors including flies, rodents, insects, and other vermin according to Rules 15A NCAC 13B .0302(5) and .0402(5).
10. The permittee shall implement and apply effective control measures to minimize and eliminate visible dust emissions and blowing litter. a. Fugitive dust emissions are prohibited.
b. Windblown materials must be collected at the conclusion of each day of
operation, and no windblown material may be allowed to leave the facility boundary according to Rules 15A NCAC 13B .0302(7) and .0402(7). 11. Interior roadway must be of all-weather construction and maintained in good condition.
12. All sedimentation and erosion control activities must be conducted in accordance with the Sedimentation Control Act, N.C.G.S. 113A-50 et seq., and rules promulgated under 15A NCAC 4. The Section must be notified of any approved modifications to the sedimentation and erosion control plan.
13. Facility construction, operations or practices must not cause or result in a discharge of pollution, dredged material, and/or fill material into waters of the state in violation of the requirements under Sections 401 and 4040 or the Clean Water Act, as amended.
14. Pursuant to Rules 15A NCAC 13B .0302(4) and .0402(4), the permittee must provide
equipment for fire control. Fire lanes must be established and maintained at all times. The dimensions of the fire lanes must be coordinated with the Fire Marshal having jurisdiction over the site.
15. Open burning of solid waste is prohibited. Fires must be reported to the Regional
Environmental Senior Specialist for the facility with 24 hours or the occurrence, followed by a written notification within 15 calendar days of the occurrence.

16. Copies of this permit, the approved plans, and all records required to be maintained by the permittee must be maintained at the facility and made available to the Section upon
request during normal business hours.
17. The permittee must maintain a record of the amount of solid waste received at the facility, including daily records of waste received and origins of the loads. Scales must be used to weigh waste. The daily records are to be summarized into a monthly report
for use in the required annual reports. Documentation of delivery of all recovered
material to valid end-users, processors, or recyclers must be maintained in the facility operating record according to the approved plan (DIN 28819). 18. On or before August 1 annually, the Permittee must submit an annual facility report to the
Section, on forms prescribed by the Section.
a. The reporting period shall be for the previous year beginning July 1 and ending June 30. b. The annual facility report must list the amount of waste received in tons and be
compiled:
i. On a monthly basis. ii. By county, city or transfer station of origin. iii. By specific waste type. iv. By receiving disposal facility.
v. By diversion to alternative management facilities.
c. The completed report must be forwarded to the Regional Environmental Senior Specialist for the facility by the date due on the prescribed annual facility report form.
d. A copy of the completed report must be forwarded to each county manager for each county from which waste was received at the facility. Documentation that a copy of the report has been forwarded to the county managers must be sent to the Regional Environmental Senior Specialist by the date due on the prescribed
annual facility report form.

1. This permit approval to operate issued for the transfer station is the life-of-site permit as defined in N.C.G.S. 130A-294(a2), which shall expire on June 10, 2073.
2. The transfer station is permitted to receive construction and demolition (C&D) solid waste as defined in N.C.G.S. 130A-290(a)(4), which is consistent with the amended Conditional Use Permit issued by Davidson County on September 10, 2012 (DIN 17892). a. The C&D wastes are solely generated from the new construction sites and
selected demolition sites located in the permitted service areas as stipulated in
Permit Condition No. 1, Part 1, Attachment 3 of this permit. b. The C&D wastes are transported to the transfer station by a transporter affiliated with the permittee after the wastes being prescreened by the permittee
representatives at the waste sources.
c. The waste collected at this transfer station must be transported to a sanitary landfill facility that is i. permitted to receive the type of waste specified, and
ii. whose service area includes the origin of the waste.
3. The facility must not cause nuisance conditions according to Rule 15A NCAC 13B .0402 and the approved plan (DIN 28819), and must meet the following requirements at a minimum:
a. The “tipping floor” and transfer trailer loading area must be always maintained in
a clean, sanitary condition. b. Waste must only be deposited on the covered concrete “tipping floor” in piles or directly into a transfer container.
c. No waste shall be stored or accumulated on the “tipping floor” after operating hours if amount of waste received is more than 100 tons per day which are sufficient to operate for waste sorting and recovery activities at the C&D Waste T&P Unit.
d. To store and accumulate wastes up to 100 tons per day which is sufficient to operate for waste sorting and recovery activities at the C&D Waste T&P Unit, waste may conditionally be approved to be stored onsite as follow: i. Waste stored in vehicles or containers which are constructed, operated,
and maintained to be leak resistance for preventing the creation of a
nuisance to the public health from the escape of solid, semi-solid, or liquid waste. The waste-loading vehicle and containers shall always be covered with water-tight covers except the time to receiving wastes. ii. Wastes stored on the covered “tipping floor” shall not be putrescible and
covered with water-tight covers and enclosed by adequate straw wattles
around the base of waste piles or stored in leak-resistance containers to

prevent rainwater from flowing into waste storage area resulting in leachate.
iii. The maximum storage time is five (5) working days or when the
accumulated waste amount reaches to 100 tons, whichever comes first. iv. This permit condition shall be revoked, if the on-site storage of waste, either in containers or on “tipping floor,” causes any nuisance, such as odor or attractions of vectors.
4. The permittee SHALL NOT engage in any activities related to waste shredding, grinding, or processing inside the covered “tipping floor” as shown on Figure 3A (DIN 28819) unless approved by the Section.
5. All water that comes in contact with solid waste, including vehicle wash-down water, is
leachate and must be captured and properly treated before release to the environment in accordance with the approved Operations Manual (DIN 28819) and Rule 15A NCAC 13B .0402(3). a. The leachate control system, such as floor drains, leachate collection devices,
sanitary sewer connections and/or leachate storage tanks, must be operational
during facility operations. b. The “tipping floor” must drain away from the building entrance and into the leachate collection system.
2908-TP-, Waste Treatment and Processing Units 6. This permit approval to operate issues for the Treatment and Processing (T&P) Units, consisting of Wood Waste T&P Unit and C&D Waste T&P Unit as shown Figure 3 & 3A (DIN 28819) shall expire June 10, 2023. Pursuant to N.C.G.S 130A-294(a3)(2), on or
before the permit expiration date, the permittee must submit the Section a permit
amendment application for a permit review and approval; the application must be prepared according to Rule 15A NCAC 13B .0202. 7. The permittee must operate and manage received recyclables or recovered material from
the permitted C&D waste streams and wood/yard wastes according to the requirements
set forth in N.C.G.S. 130A-309.05(c) and the approved plan (DIN 28819). 8. Non-conforming wastes received at the units or wastes removed/rejected from the final processes shall be
a. Stored temporarily in the leak-resistance containers, covered by a water-tight tarp
or cover on a concrete pad, and b. Shipped to an off-site permitted facility or facilities for final disposal at the end of each operating day when the container is full or twice per month (DIN 28819), whichever comes first.
9. The 50-foot property line buffer shall be maintained free of waste and final product/recyclable or recovered material.

10. Recovered or recyclable material or final product must be temporary stockpiled in the designated area as shown on Site Plan drawing (DIN 28819) and managed as a valuable
commodity in a manner consistent with N.C.G.S.130A-309.05(c).
11. Surface water shall be diverted from all operational and storage areas to prevent standing water in operational areas and under or around storage piles. Water that comes in contact with solid waste is deemed to be leachate and shall be contained on-site or properly
treated prior to discharge according to Rule 15A NCAC 13B .0302(3).
C&D Waste T&P Unit 12. The C&D Waste T&P Unit may accept C&D waste streams up to approximately 26,000 tons annually, based on a maximum of 100 tons per day and 260 working day annually, to
generate “recovered material” or “recyclable material” as defined in N.C.G.S. 130A-
294(a)(24) and (26), respectively. The acceptable C&D waste streams are: a. Permitted by the state law, as defined in N.C.G.S. 130A-290(a)(4) and the amended Conditional Use Permit issued by Davidson County on September 10, 2012 (DIN 17892) including:
i. Recyclable/marketable materials from received C&D waste streams.
ii. Recyclable/marketable plastic, wood, scrap metal, concrete, brick, glass, cardboard, paper, sheetrock, roofing material (excluding asphalt shingle). b. Generated from the new construction or selected demolition sites within the
service areas in Permit Condition No. 1, Part I, Attachment 3 of this permit.
c. Temporarily stored on the covered “tipping floor” in a manner to comply with Permit Condition No. 3, Part VI, Attachment 3 of this permit.
13. The C&D Waste T&P Unit is only permitted to sort recyclable or recovered material
from the permitted waste streams at the picking line station. Processing or treating wastes including shredding or grinding SHALL NOT take place at this unit or at the facility unless has been granted under the special use permit and a revised operations plan has been approved by the Section.
14. C&D wastes that may contain or skeptically contain asbestos SHALL NOT be sorted, treated, or processed at this unit, unless an asbestos screening plan has been submitted to the Division of Epidemiology of the Department of Health and Human Services for approval. The permittee must submit the Section the approved plan.
15. Operating the C&D Waste T&P Unit shall be temporarily ceased in high wind days or
rainy days at the discretion of the permittee according to the approved plan (DIN 28819). 16. After sorting, collected recyclable or recovered material shall be a. Temporarily stored in covered containers on a concrete pad or in containers inside
a roofed concrete pad.

b. Maintained in reasonably sized piles with adequate fire breaks and lanes in accordance with the approved operational plans and the pertinent rules and Permit
Condition No. 14, Part I, Attachment 3 of this permit. Wood Waste T&P Unit 17. The Wood Waste T&P Unit may accept permitted wastes up to approximately 200 tons
per day for processing. The approved waste streams are temporarily stored at a 200-feet
by 240-feet concrete pad as shown on Figure 3 (DIN 28819): a. Wood waste for mulching includes wooden pallet as defined in N.C.G.S 130A-290(a)(44a) and unpainted and untreated furniture wastes. b. Wood waste for boiler fuel includes painted or treated wood, dimension lumber, engineering wood, and/or chipboard except creosote timber/wood which is a nonconformance waste.
c. Yard waste as defined in Rule 15A NCAC 13B .0101(56) including land-clearing debris, untreated and unpainted wood but excluding yard trash as defined in N.C.G.S. 130A-290(a)(56).
18. Yard wastes processing for mulching shall be separated from processing wood waste for boiler fuel.
19. The processed wood or yard wastes shall be temporarily stored in containers or piles or windows and properly managed on-site: a. The windrow or pile shall have the height less than 15 feet.
b. The windrow or plie shall be timely moved from different locations as shown on Figure 3 (DIN 28819) to segregate the products by type and age and to prevent heat generating inside the stockpiles from reaching the temperature resulting in spontaneous combustion.
c. Fire lane must be established and constantly maintained according to Permit Condition No. 14, Part I, Attachment 3 of this permit.
20. Composting and curing are NOT PERMITTED at this facility.
