PURPOSE OF SITE VISIT: Complaint Investigation – Partial Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: The 15A NCAC 13B .0402 (1) states: Operational plans shall be approved and followed as specified for the facility. 1. 2613T Permit to Operate, Attachment 3, Part VI: 15(a) The tipping floor and transfer trailer loading area must be maintained in a clean, sanitary condition and must be cleaned at least daily in accordance with the approved plans. The facility is in violation of the above permit condition in that large amounts of waste, which was generated over the course FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 7 multiple days per facility staff, was observed on the ground outside the area of the tipping floor. 2. 2613T Permit to Operate, Attachment 3, Part VI: 15(b) Waste must only be deposited on a “tipping floor” or directly into a transfer container. Waste must not be stored on the “tipping floor” after operating hours. The facility is in violation of the above permit condition in that the facility had a large mound of comingled metal, municipal and construction wastes stockpiled outside the of the tipping floor. 3. 2613T Permit to Operate, Attachment 3, Part VI: 15(c) Waste may be stored on-site, in transfer trailers constructed, operated, and maintained to be leak resistant, with watertight covers, a maximum of 24 hours except that a minimal amount of waste may be stored for a maximum of 72 hours when the facility is closed during a weekend or holiday. Storage of the waste must not cause any nuisance, such as odor or attraction of vectors. The facility is in violation of the above permit condition in that the facility had a strong sulfur odor and waste was stored on site in roll-off containers that were not covered. 4. AAA Hauling of NC Inc. Transfer Station, Approved Operating Procedures (DIN 1086075); Trucks after Dumping (4): Sort and dispose in the proper containers. The facility is in violation of the above operating procedure in that waste was not sorted into appropriate containers for recycling and disposal after being dumped. 5. AAA Hauling of NC Inc. Transfer Station, Approved Operating Procedures; Concrete, Brick and Asphalt (1): All waste material, painted concrete with exposed rebar must be removed prior to stockpiling this material. The facility is in violation of the above operating procedure in that painted material was stockpiled and commingled with clean concrete, brick and asphalt. 6. AAA Hauling of NC Inc. Transfer Station, Approved Operating Procedures; Land Clearing debris and Clean Wood (2) All waste, painted and treated lumber shall be placed in a container to be disposed of at the landfill. The facility is in violation of the above operating procedure in that painted and treated lumber was observed stockpiled on the ground. 7. AAA Hauling of NC Inc. Transfer Station, Approved Operating Procedures; Wood Grinding (3): Ground wood will be containerized and shipped to customer. The facility is in violation of the above operating procedure in that ground wood was observed stockpiled on the ground. 8. AAA Hauling of NC Inc. Transfer Station, Approved Operating Procedures; Permit Modifications (2) Operating Hours in Revised Operating Procedures: M-F 7:30am-5pm. The facility is in violation of the above operating procedure in that the facility has accepted waste outside of the specified operating hours. For your reference, please see the attachment 2613T_TICKETS_2018. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 7 ADDITIONAL COMMENTS 1. 2613T is a transfer, recycle, resource recovery and processing facility owned by AAA Hauling of NC, Inc. (AAA) and operated by Northeast Alternative Fuels, LLC (NAF). 2. This inspection was conducted to investigate a complaint that waste was not being removed from the transfer station and that the facility was operating outside of hours specified in the approved operating procedures. 3. Mike Stine, NAF, was notified by phone during this inspection of the conditions found at the transfer station. 4. At the time of this inspection the facility had a strong sulfur odor not typical of this type of facility. 5. AAA and NAF shall ensure, per the Permit to Operate, that the facility is receiving waste generated within the areas consistent with the service area of the receiving landfill. For example: Cumberland Co MSW Landfill is only permitted to accept waste from generators within Cumberland County. 6. UCorrective measures are necessary and shall be completed by October 26, 2018, to bring the site into compliance with the rules, permit and approved operations plan. 7. UThe transfer station shall cease accepting waste until such time that the corrective measures are completed. 8. A Notice of Violation Letter (NOV) will follow this inspection report. The NOV will be sent via certified mail.
