ADDITIONAL COMMENTS
On March 23, 2016, John Patrone met with Mike Spencer and Robby Stone to conduct a comprehensive inspection of
the City of High Point Kersey Valley MSW Landfill on E. Kivett Drive in High Point, Guilford County.
1. The municipal solid waste (MSW) landfill is located on property owned by the City of High Point. The
property also contains a treatment and processing (T&P) operation, a convenience center, and a temporary
disaster debris staging site (TDDSS).
2. The MSW landfill consists of two areas: Area 1, Phases 1 – 3A and Area 2, Phases 4 and 5A.
3. Landfill Area 1 is inactive. The landfill has recently been capped. Work is estimated to be completed in the
coming weeks. The east side slope contains intermediate cover that will be maintained for future development.
4. Landfill Area 2, Phase 5A is active.
5. The facility has begun construction on landfill Area 2, Phase 5B. Attachment 2 - Conditions of Permit to
Construct requirements shall be met prior to operation of Phase 5B.
6. In the future, the facility plans to reroute the portion of Kersey Valley Road that runs between landfill Areas 1
and 2 in order to expand the landfill Areas into one another.
7. The facility is open Monday through Friday 7:30 am to 4:30 pm and Saturday (convenience center only) 7:30
am to 1:00 pm.
8. The facility site plan, permit, and operations plan were discussed.
9. The facility is permitted to receive solid waste from Davidson, Forsyth, Guilford, and Randolph Counties.
10. The following are certified personnel:
a. Michael Spencer, Manager of Landfill Operations, No. 905194, exp. 06/07/16
b. David Wayne Hunt, Certified Landfill Operations Specialist, No. LF-2012045, exp. 10/02/18
c. Charles Scearce, Certified Landfill Operations Specialist, No. LF-2015020, exp. 03/24/18
11. The facility maintains waste screening reports. At least one vehicle per week but not less than one percent by
weight of the waste stream shall be screened. Records for April 1, 2015 through March 17, 2016 were verified.
12. The facility does not accept scrap tires.
13. White goods are placed in a roll-off container at the convenience center. The white goods are hauled to the City
of High Point Material Recovery Facility (MRF) ~ once a week.
14. The convenience center primarily serves as a MSW drop-off for residents.
15. The facility has inbound and outbound scales. Each has an outside weight display unit.
16. A vehicle scale test was conducted by J.A. King, inbound and outbound scales, on March 17, 2016.
17. A vehicle scale test was conducted by the North Carolina Department of Agriculture & Consumer Services,
inbound and outbound scales, in August 2015.
18. The facility maintains records of the amount of solid waste received. The amount of MSW received from April
1, 2015 through March 23, 2016 (at time of inspection) is 106,200.97 tons.
19. The facility annual report (FAR) dated July 9, 2015 was received by the SWS. Facility throughput for July
2014 through June 2015 is 110,549.61 tons.
20. The facility is permitted to co-dispose of wastewater treatment sludge. Mr. Spencer stated that wastewater
treatment sludge is not currently accepted and has not been accepted in ~ two years.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

21. The facility is permitted to use tarps. Two tarps are commonly used. Each tarp is ~ 50’x100’. Daily or
intermediate soil cover shall be used every Friday or more frequently if inclement weather is forecasted.
22. The facility has 14 groundwater monitoring wells sampled for laboratory analysis: MW-1 (background), MW-
3A, MW-4, MW-6A, MW-8A, MW-9, MW-10, MW-11, MW-12, MW-13S, MW-14, MW-15, MW-16, and
MW-17. Four other groundwater wells are monitored for water levels.
23. The facility has 8 surface water monitoring locations: SW-1 (background), SW-3, SW-5, SW-6, SW-7, SW-8,
SW-9, and SW-10.
24. The facility maintains semiannual groundwater and surface water monitoring and leachate test records
submitted by Babb & Associates, P.A., analyzed by Environmental Conservation Laboratories, Inc. (ENCO).
Records for groundwater and surface water monitoring and leachate testing conducted on October 22-23, 2014,
April 29-30, 2015, and November 14-15, 2015 were verified. An exceedance is noted for each event.
25. Ensure groundwater monitoring wells are labeled in accordance with the facility water quality monitoring plan
or agreed upon identification.
26. Ensure the monitoring well observed (along access road to Area 1 landfill cap) that appeared to have been hit by
a vehicle is repaired accordingly.
27. The facility has 9 landfill gas monitoring wells: GW-1, GW-2, GW-3, GW-4, GW-8, GW-9, GW-10, GW-11,
and GW-12.
28. The facility maintains quarterly methane monitoring records. Monitoring is conducted by Smith+Gardner, Inc.
Records for methane monitoring conducted June 24, 2015 (2nd quarter), September 17, 2015 (3rd quarter), and
December 24, 2015 (4th quarter) were verified. Monitoring results do not indicate an exceedance of the
methane lower explosive limit (LEL). Mr. Spencer stated that the 1st quarter 2016 methane monitoring event
was conducted on March 8, 2016.
29. The facility has installed a landfill gas extraction network in Area 1 for expected future use. Landfill gas
extraction well heads have not been installed and the landfill gas collection station has not been constructed.
30. The facility has installed four candlestick flares atop Area 1. The flares are used for the combustion of passive
landfill gas. The flares automatically ignite when needed. If the flares do not function, landfill gas will vent via
the unfinished landfill gas extraction well head caps. The caps are designed to pop off to vent the landfill gas.
31. It is suggested that the facility create a landfill gas flare and extraction well head cap inspection schedule.
32. It has been stated that the facility’s consulting engineering firm determined that a Division of Air Quality
(DAQ) permit is not required at this time.
33. Leachate from Area 1 is piped to a leachate pond. Leachate from Area 2 is pumped into a 340,000 gallon
storage tank with secondary containment.
34. During the inspection the leachate pond had ~ 4 feet of freeboard and the leachate storage tank was at 11.5 feet.
35. Leachate is hauled to the City of High Point Eastside Wastewater Treatment Plant (WWTP). Leachate hauling
records were verified for April 2015 through February 2016. The facility generally hauled 280,000 – 630,000
gallons a month.
36. The facility has an Industrial User Pretreatment Permit (IUP) No. 0113 issued by the WWTP that expires on
July 1, 2017.
37. The leachate collection lines are required to be flushed and camera inspected once every five years. The
leachate collection lines were flushed and inspected by Jetclean America in November 2015 (Areas 1 and 2,
Phases 4 and 5A), September 2010 (Area 2, Phase 4), and May 2010 (Area 1).
38. The facility has installed a pump station that will be connected to the municipal sewer system in the future.
39. The facility has a stormwater National Pollutant Discharge Elimination System (NPDES) permit, General
Permit No. NCG120000. The NPDES permit was issued November 1, 2012 and expires October 31, 2017.
40. The facility has an erosion and sedimentation control plan certificate of approval for Areas 1 and 2, approved
with modifications December 22, 2014.
41. The facility has two soil stockpile areas on site.
42. The facility financial assurance is under review.
43. The working face was small and compact.
44. The facility has reapplied six inches of soil cover to the southwest side slope of Area 2, Phase 4.

45. The landfill cap (Areas 1 and 2) has been sown with grass seed due to recent construction and grading activities.
Much of the landfill cap does not yet contain vegetative material. It is expected that the landfill cap will be able
to be mowed in ~ 2 years.
46. Mr. Spencer stated that erosion rills in the external side slopes will be repaired as the cap settles.
47. Sedimentation pits observed appeared maintained. Additional maintenance is required due to recent
construction activities.
48. The facility has white edge of waste markers in Area 2. Mr. Spencer stated that the edge of waste markers
removed for construction of the landfill cap in Area 1 will be reinstalled.
49. The facility has a wood waste treatment and processing (T&P) operation. Land clearing debris, high
carbon:nitrogen ratio material, pallets, treated wood, lumber scraps, and furniture manufacturing waste is
ground for use in the landfill. Mr. Spencer stated that all ground material is used on the landfill working face
access road during inclement weather.
50. The facility grinds material once or twice a year.
51. The facility maintains records of the amount of wood waste received. Material received from April 1, 2015
through March 23, 2016 is 1.90 tons.
52. Ensure painted wood is not accepted to be ground. It shall be placed in the landfill upon receipt.
53. Ensure the wood waste T&P operation is routinely graded such that stormwater does not pond.
54. Trash mixed-in with wood waste shall be removed daily.
55. Only mulch from clean wood shall be used outside of the lined landfill area.
56. The area allotted for the wood waste T&P operation is ~ 2 acres. The area is also designated as a temporary
disaster debris staging site (TDDSS), number DS41-004.
57. During the inspection odor was not detected.
58. Windblown material was being picked up by facility personnel.
59. The City of High Point Fire Department can be contacted to respond to an emergency.
60. Access roads are of all-weather construction.
61. The facility has signage.
62. The facility entrance is secured by a locked gate.
63. The PTO expiration date is February 3, 2020.
64. The PTO renewal application shall be submitted to the SWS by June 3, 2019.
