OBSERVED VIOLATIONS:

1. 15A NCAC 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee(s) shall be
considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.”

General Permit Condition Number 7(a) of Permit to Operate 8004T-Transfer-1995 states: “All water that
comes in contact with solid waste, including vehicles wash-down water, is leachate and must be captured and
properly treated before release to the environment in accordance with the approved Facility Operations Plan
(DIN 28794) and Rule 15A NCAC 13B .0402(3).
a. The leachate control system, such as floor drains, leachate collection devices, sanitary sewer connections
and/or leachate storage tanks, must be operational during facility operations.

During the inspection of the loading bay, leachate was standing in the exterior wall drainage pit. Facility staff stated a

plumber will be contacted and scheduled to unstop the drain as soon as possible.

Waste Management of the Carolinas, Inc is in violation of 15A NCAC 13B .0203(d) in that the leachate control
system was not operational during facility operations and that the leachate did not drain into the leachate
collection system. To achieve compliance, Waste Management of the Carolinas, Inc. must immediately contact a
plumber to unstop the exterior wall drain and perform regular maintenance to all leachate collection devices to
ensure free flow of leachate into the collection system.

2. 15A NCAC 13B .0402(1) states: “Operational plans shall be approved and followed as specified for the facility”.

The approved Facility Operations Plan Waste Management of Carolinas, Inc. dated January 20, 2018 (DIN
28731, Page 5) “Housekeeping & Vector Control” states: “In order to avoid nuisance conditions the tipping
floor and transfer trailer loading area will be maintained in a clean, sanitary condition at all times. The tipping
floor and loading bay will be cleaned at least daily in accordance with this Plan.

Wastes will only be deposited on the facility’s tipping floor, or deposited directly into a waste transfer container;
and no waste will be stored on the tipping floor after operating hours. Waste may be stored on-site overnight as
outlined above in Section 3.0 – Equipment; however, in no case will the storage of the waste cause a nuisance,
such as odor or attraction of vectors. Effective vector control measures will be applied at all times to control for
potential vectors including flies, rodents, insects, and other vermin.

At the end of each working day the facility tipping floor, area behind associated push walls, and loading bay shall
be cleared of extraneous waste. The tipping floor and loading bay shall be broom swept, raked, and washed
down as necessary each day to remove accumulated waste and/or leachate. The facility’s tipping floor is
designed so that liquids (e.g., wash water and leachate) drain to a series of wastewater drainage grates at the
front of the tipping floor. Additional drainage ports are located at the base of the push wall above the loading
bay. These ports must be cleaned at the end of each working day, or as necessary, in order to maintain positive
discharge into the loading bay.

Liquids entering the loading bay flow to either the central exterior wall drainage pit, or are captured by the floor
drains located at both ends of the loading bay. All wastewater drainage is piped to an exterior oil-water
separator located adjacent to the long exterior wall of the loading bay, prior to piped discharge to an off-site
pump station maintained by Salisbury-Rowan Utilities.

These loading bay drains must be cleaned at the end of each working day, or as necessary, in order to maintain
positive drainage into the oil-water separator.

The oil-water-separator consists of three chambers in series which are checked for accumulation of separated
liquids and sediment on a weekly basis. Pumping of the unit is currently performed on a semiannual basis, but is
subject to change based upon actual conditions observed during weekly inspections.

Control measures will be utilized to minimize and eliminate visible dust emissions and blowing liter. Windblown
materials will be collected by the end of the day and no windblown material will be allowed to leave the facility
boundary.”

During the inspection of the pit area, leachate was standing in the exterior wall drainage pit. Facility staff stated a
plumber will be contacted and scheduled to unstop the drain as soon as possible.

Waste Management of the Carolinas, Inc. is in violation of 15A NCAC 13B .0402(1) in that daily
housekeeping is not being performed. To achieve compliance, Waste Management of Carolinas, Inc. must
immediately contact a plumber to unstop the exterior wall drain and perform daily housecleaning in
accordance to the approved operations plan.

ADDITIONAL COMMENTS
1. Waste Management of Carolinas, Inc. owns the facility, and contracts with Custom Ecology, Inc. (CEI) to operate
the transfer station. The scale house operator is the only Waste Management on-site employee.
2. The required signage is posted at the entrance of the facility to prevent unauthorized access.
3. The facility is secured by a gate at the entrance of the facility.
4. The facility accepts an average of 170 tons of waste each operating day.
5. All waste is taken to the Great Oak Landfill (Permit #76-07).
6. A section of the tipping floor had been sectioned off for recyclables. Photos were requested to ensure all waste is
removed from jersey walls at the end of each operating day.
7. Ensure all recyclable materials are removed from behind the jersey walls and from the beams at the end of each
working day.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

8. No unacceptable waste streams were observed.
9. The tipping floor of the transfer station was well managed and free of residues.
10. Leachate is discharged into the Rowan County Sanitary Sewer system. The grit chamber and oil-water separator
was inspected on December 2017 by Safety Clean.
11. An intense odor of leachate was evident in the area of the loading bay. Upon inspection of the loading bay area,
leachate was found ponding around the drain which was not functioning.
12. Three fire extinguishers are available throughout the facility and located in heavy equipment for fire suppression.
13. A roll off is staged for scrap tires.
14. Reviewed the permit, operations plan, waste screening (1-2 per week), training records and tonnage records. Any
unacceptable waste observed is noted on the waste screen forms along with actions taken to dispose of those waste.
