Dear Ms. & Mr. Cooper:
On August 16, 2018, Connie S. Wylie, representing the State of North Carolina, Division of Waste
Management Solid Waste Section, inspected the above referenced facility for compliance with
North Carolina solid waste statutes and rules. The following violations were noted:
A. 15A NCAC 13B .0838(a)(15) Grease septage shall be diluted at least 1:1 from its
concentration when pumped with domestic septage or water if land applied over perennial
vegetation. Grease burns were noted on Field 1. Also noted bare patches of vegetation that
appear to be damaged areas from older grease burns.
B. 15A NCAC 13B .0838(a)(18) Approved nutrient management plans shall be followed.
Field 1 has not been harvested in a timely fashion and has exceeded the required harvest height
of 12‐18 inches per the approved plan. Land application has occurred on this field.

C. 15A NCAC 13B .0838(a)(3) The permit holder of a site where more than one septage
management firm has been authorized by the Division to discharge septage shall submit a
monthly report to the Division which shall include the required information for each discharge.
Another firm other than Cooper Septic Tank Service is authorized to discharge on this site and
has been using this site. This office has not been receiving a copy of the site logs each month
as required by this Rule.
Based upon the foregoing, Cooper Septic Tank Service shall come into compliance by August 31,
2018 with all requirements of the regulations in 15A NCAC 13B .0838(a)(15 &18) & .0838(d)(3)
by completing the following:
1. All grease septage shall be adequately diluted to prevent any grease burns.
2. Land application shall cease on Field 1 until the field is harvested in accordance with the
required 30 day wait after the last discharge event.
3. No land application shall occur at this site until all of Field 2 is completely harvested and
the hay removed. At the time of this inspection Field 2 was partly harvested and was
not available for land application.
4. Submit a copy of the site logs since the other firm began discharging on this site.
5. Cooper Septic Tank Service shall provide a written certification with supporting
documentation on company letterhead confirming the noted compliance schedule has
been completed. Include in this certification any actions taken to prevent these
violations from occurring in the future. Mail this certification to Connie S. Wylie,
Division of Waste Management, Fayetteville Regional Office, 225 Green Street, Suite
714, Fayetteville, NC 28301 by August 31, 2018.
The violations listed above were observed by Section staff and require action on behalf of the
facility in order to come into or maintain compliance with the Statutes, Rules, and/or other
regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A‐22,
an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid
Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the
N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management
facility or a solid waste collection service and any such further relief as may be necessary to
achieve compliance with the North Carolina Solid Waste Management Act and Rules.
