The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Permanent, easily visible markers are in place to show the edge of waste area for the yard waste.
2. The yard waste site is located on the same tract of land where the town’s public works materials are kept.
3. The yard waste site remains separated from the public works area, including the 50 foot buffer around the yard
waste area.
4. All setbacks are in place.
5. Waste Industries is still contracted for collection of the Town of Benson’s yard waste.
6. Records not reviewed at this inspection.
7. Temperature of all compost produced shall be monitored sufficiently to ensure that the compost process is
maintained for at least three consecutive days at or above 131°F. Once time and temperature been met compost
can be distributed.
8. There is at least a 25 foot access path around the site for fire control vehicles.
9. Ensure that an adequate fire lane is maintained between windrows.
10. Ponding of water observed in yard waste area. Grade yard waste area to ensure positive drainage of
surface water off the yard waste area within 30 days.
11. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be
completed within 30 days’ receipt of this report. The SWS will conduct a follow-up inspection in 30 days
to ensure issues noted in this inspection report have been addressed.
