The facility is permitted as a large Type 1 compost facility, and may accept only land clearing debris (vegetative material such as stumps, tree trunks and branches and wood chips), yard trash (including grass clippings and leaves) and clean, untreated, unpainted wood waste (such as crates and pallets). 2. The facility was formerly a yard waste notification site. However, operations expanded beyond the limits of a notified operation and a permit was applied for to accommodate the city’s requirements. 3. The facility is also an approved temporary disaster debris storage site (DS79-002). Debris storage is still workable with the expanded operations at the site. 4. A grinding contractor was onsite and operating during the time of this inspection. Ms. Knowles stated that no other operations had taken place on the site under the new permit as yet. She explained that city staff perform curbside brush collection year-round, and the material being ground was the result of that collection. 5. Mr. Stocks stated that the grading plan that had been submitted with the permit application had recently been examined by the city and was found to require approximately $150,000 in contracted expense. He asked if the plan could be reviewed to determine whether, in fact, any of this work would actually be required in order to operate the facility. 6. Operations performed under the former yard waste notification were discussed, and it was noted that the site had always been adequate for the expansion of operations. Mr. Frost stated that he was very comfortable with operations resuming with the existing grading and site layout, and that the approved grading plan is not a requirement of the solid waste permit. However, he cautioned Mr. Stocks that some or all of the elements of the approved grading plan might be requirements of the erosion and sedimentation control and/or stormwater permits. Mr. Stocks stated that he would contact Shannon Leonard, DEMLR, to discuss these permit requirements prior to eliminating the grading plan. 7. The site was observed to be very clean and well-maintained. No windblown litter was found, and dust from the grinding operation was well-controlled. 8. The access roadways are of all-weather construction and in good condition. 9. The site is secured by means of a perimeter fence and a gate which is kept locked when city staff are not present. It should be noted that the site is not open to the public except when compost is offered; and, only city trucks bring waste to the site. 10. Prior to beginning operations, a sign must be installed at the entrance to the facility that includes, at minimum, the permit number, emergency contact information and the hours the facility is open (or not open) to the public. Please ensure that proper signage is installed, as required by 15A NCAC 13B .1406(8), prior to beginning operations. 11. Mr. Frost stated that, once a determination is made as to final grading requirements, he will reissue the permit to specifically include the grinding operations. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
