Dear Mr. Hunt:
On July 27, 2018, Connie S. Wylie, representing the State of North Carolina, Division of Waste
Management Solid Waste Section (Section), inspected the above referenced facility for
compliance with North Carolina solid waste statutes and rules. Upon exiting the site Ms. Wylie
encountered Mr. Eric Locklear and discussed the violation observed during this inspection. The
following violation was noted:
A. 15A NCAC 13B .0838(c)(1) Domestic septage shall be treated in accordance with the
requirements in 40 CFR Part 503. 15A NCAC 13B .0838(c)(2) Grease septage,
treated grease septage, commercial or industrial treatment plant septage, and
commercial/industrial septage shall be treated in accordance with 40 CFR 257.3‐6
or treated by an equivalent or more stringent process in 40 CFR 503 Subpart D.
Permit Condition 2 The pH of domestic septage shall be raised to 12 or higher by
alkali addition and, without the addition of additional alkali, shall remain at 12 or
higher for 30 minutes prior to land application per .0838(c)(1). The pH of grease
septage or grease septage mixed with domestic septage shall be raised to pH 12 or
higher by alkali addition and, without the addition of additional alkali, shall remain
at 12 or higher for 2 hours prior to land application per .0838(c)(2).
On Field 3 I checked the pH of a discharge event that occurred while I was on site. A
pH of 5 was noted in different spots along the spray path which is not the required
pH of 12 or higher. I also checked the pH at the wet outlet of the red tank vehicle
that was used for the land application of this waste and it was again a pH 5.

Based upon the foregoing, Enviro Choice dba Brian’s Waste Recycling, shall come into compliance
immediately with all requirements of the regulations in 15A NCAC 13B .0838(c)(1 & 2) by
completing the following:
1‐ Enough lime shall be added to all septage waste to achieve a pH 12 or higher and hold
for the required time (1/2 hour for domestic, 2 hours for grease) prior to land
application. The pH shall be checked again immediately prior to discharge and no land
application shall occur if the pH is less than 12.
Enviro Choice dba Brian’s Waste Recycling shall provide a written certification with supporting
documentation on company letterhead confirming the noted compliance schedule has been
completed. Include in this certification any actions taken to prevent this violation from occurring
in the future. Mail this certification to Connie S. Wylie, DWM/SW, Fayetteville Regional Office,
225 Green Street, Suite 714, Fayetteville, NC 28301 by August 17, 2018.
The violation listed above was observed by Section staff and require action on behalf of the
facility in order to come into or maintain compliance with the Statutes, Rules, and/or other
regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A‐22,
an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid
Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the
N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management
facility or a solid waste collection service and any such further relief as may be necessary to
achieve compliance with the North Carolina Solid Waste Management Act and Rules.
Please keep me informed of your progress in this matter. Solid Waste Section staff will conduct
a follow‐up inspection to verify that the facility has completed the requirements of this Notice of
Violation.
