Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. This facility was issued a permit to operate on May 8, 2017 for the acceptance and processing of inerts, yard and land clearing waste, and construction and demolition waste. 2. The facility permit and operations plan were reviewed and discussed with operator. 3. The facility is in operation Monday through Friday, 6:00 am – 7:00 pm. Facility will be closed on Christmas, New Year’s Day, Memorial Day, Independence Day, Labor Day, and Thanksgiving Day. When not in operation, the facility is secured by a locked gate. 4. The scale house and truck entrance to the facility have been relocated to allow for better ingress/egress as well as some realignment of waste storage and processing areas to promote efficiency in the operations. Active sorting and processing of concrete waste, land clearing debris, and C&D waste was observed. 5. Proper signage at the front gate noting the facility permit # as well as the waste acceptance protocols. 6. Operator stated all loads are being screened and unacceptable materials are rejected. Formal waste screening plan has been developed and was reviewed with operator. Waste screening records verified for March 1, 2018 through July 20, 2018. 7. All facility staff directly involved with waste acceptance and/or processing should be periodically trained on all aspects of the approved permit and operations plans, including the waste screening protocols. Documentation of such training(s) should be kept for Section review upon request 8. Reminder that even though it is not required, consideration should be given to seeking external training for members of the facility staff on transfer station operations through SWANA or similar entity as they cover many of the same operational components as this facility. 9. Town of Apex Fire Department to has been out to site to conduct a site survey to address any issues they might have if called to the site due to a fire. 10. Concrete is stored until it is crushed periodically onsite. Painted block, concrete and asphalt delivered to the facility must be checked for lead paint prior to acceptance. Painted block, brick and asphalt at the facility must be removed and properly disposed of. 11. Wood material and mulch are being stored in piles no larger than 30 feet high and 50 feet wide, unlimited length within the approved site boundaries as required by facility permit. All waste staged for transport and operational areas where waste may be piled up for processing must be managed on an impervious surface that will not allow leachate to come in contact with ground or surface waters. Operator stated depressions and cracks in the working area are repaired as noticed. The tipping floor/operations concrete pad appeared to be adequately maintained.
