Box 184 Stanley, NC 28164 PARTICIPANTS: Troy Harrison, Composting & Land Application Branch Shane Roberts, Earth Farms, LLC STATUS OF PERMIT: Active Issued: 3/16/2017 Expires: 3/16/2022 PURPOSE OF SITE VISIT: Routine Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: N/A The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. Facility is permitted as a Large, Type 3 Solid Waste Compost Facility. 2. The screening operation is located on a portion of the property that was permitted as a Septage Land Application Site (SLAS-36-04) Field Number 1. The property boundary is located adjacent to this area. A 100-foot buffer is required to be maintained between the composting area and the property boundary. It is the responsibility of the operator to maintain the buffer. 3. A gate is located at the entrance. 4. No objectionable odor was detected beyond the facility boundary during the inspection. 5. Access to the facility is secured with a lockable gate. 6. The access road to the facility was well maintained. 7. Approved setbacks appear to be properly maintained. 8. Windrows appeared to be sufficiently spaced to allow access for firefighting equipment. 9. As a reminder, 15A NCAC 13B .1406 (4) requires leachate to be contained on site or treated to meet operational standards of the off-site disposal method. An area of ponded leachate (see below) was observed on the Northeastern border of the compost area next to a land application field and the South Fork Catawba River. A tank between windrows to collect leachate was observed; however, it had not been placed into use. 10.
