Thomas is in violation of 15A NCAC 13B .0566(2) for accepting unpermitted waste for disposal in the James Road Stump Dump LCID Landfill, including concrete with rebar and metal attached, pressed board and treated lumber. These materials were observed in the working face of the landfill during this inspection. To achieve compliance, Bruce C. Thomas must remove the unpermitted waste from the landfill unit, dispose of it properly at a facility permitted to receive this waste, and provide proof of proper disposal in the form of landfill disposal receipts. The facility is protected from unauthorized access by means of berms, natural topography, fencing and a locking gate which is secured when the facility is not open to the public. Proper signage was observed at the facility entrance. 2. The site was found to be clean and well maintained. No windblown litter was observed. 3. The access roadway was of all-weather construction and in good condition. The large tipping area was level and provided ample room for trucks and equipment to maneuver safely at the facility. 4. The site is designed so that stormwater flows to the east end of the site into a sediment trap. No erosion was evident, and no ponding water was visible at the facility. 5. The working face was long and shallow and appeared to be well managed. Some unacceptable materials were found in the working face. (Please see Observed Violations section of this report for additional information.) 6. The working face was well under an acre in size, and it appeared that the waste had not yet been compacted into the landfill. Mr. Thomas stated that he covers the active area of the landfill as necessary, and compacts it before covering. Please ensure that the working face of the landfill is covered monthly, or more often if necessary, with at least 6” of clean soil. In this instance adequate soil cover must be applied to the landfill by July 21, 2018 – one month from the date of this inspection. 7. It is recommended that a log be kept noting each date that the landfill is covered. The log can be used to verify that adequate soil cover is applied monthly, as required by 15A NCAC 13B .0566(4). 8. Several piles of large logs were observed at the facility. Mr. Thomas stated that, as loads arrive, larger logs are separated and stockpiled for delivery to a sawmill or for splitting into firewood. 9. A dead cow was found to the north of the working face among the weeds at the edge of the tree line. Mr. Thomas stated that he hadn’t known the cow was there, adding that it may have wandered onto the property or perhaps had been illegally dumped at the site. Please ensure that the cow carcass is removed from the site and disposed of properly. 10. 15A NCAC 13B .0566(8) states, in part, “An attendant shall be on duty at all times while the landfill is open for public use to assure compliance with operational requirements and to prevent acceptance of unauthorized wastes.” Please ensure that an operator is on duty at all times when the landfill is open to the public. 11. Please provide an email address for future correspondence with the Solid Waste Section. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
