EXPIRES: 02/21/15 PURPOSE OF SITE VISIT: Routine STATUS OF PAST NOTED VIOLATIONS: No violations noted on the previous inspection conducted on 10/09/15. OBSERVED VIOLATIONS: 1. Upon review of the submitted records, it was noted that the monthly application rate for Coastal Bermuda overseeded with rye was exceeded on the Field for the month of October in 2012 and 2013. Exceeded the monthly application rate is a violation of Rule .0838(a)(18) that states “Approved nutrient management plans shall be followed” and Permit Condition 7 which lists the monthly rates for none, low, medium, and high. The maximum annual application rate for the Field was not exceeded for either 2012 or 2013. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 AREAS OF CONCERN AND COMMENTS: 1) Required signage present along access road before you get to the site. 2) Access road is well maintained. 3) Most markers up. One marker down along the southern edge before you get to the wet area of the field. 4) No septage discharges noticed outside of the permitted boundary of the field. 5) No recent septage applications noticed. No spot dumps or thick applications noticed today. 6) Russ is planning on cutting the bermudagrass soon. Waiting for the weather to cooperate. Good stand of bermudagrass in the permitted field. Some weed control needed. 7) No application at time of inspection. pH not checked. 8) No objectionable odors noticed today. 9) No issues noted with setback distances. 10) Application for permit renewal received on 10/22/14. Reviewed and modified the nutrient management plan with Russ. Made changes to the nutrient management plan concerning the monthly rates and 80% crop coverage. Monthly application rates to Coastal Bermuda overseeded with rye adjusted for the higher permitted maximum annual application rate of 100,000 gal/ac/yr within the nutrient management plan. Current monthly application rates were defined in the permit. Monthly application rates for Coastal Bermuda should match now within the nutrient management plans for SLAS-59-05 and SLAS-59-02. 11) Also, reviewed the land application logs. The monthly application rate for the Field was exceeded for the month of October in 2012 and 2013. The permit has a monthly application rate of 10,000 gal/ac for the low months which includes October. The records showed that 11,884 gal/ac was applied in October 2012 and 10,526 gal/ac was applied in October 2013. 12) Russ is working on adding more land to the permit. I reviewed with Russ the documents that are needed to add the land to the permit. Russ and Bennie Moore drove me around the area they are looking to add. Area was sprigged in Coastal Bermuda. Hard to see any bermudagrass due to the coverage of crabgrass. 13) Application records for 2015 thru 2016 was emailed on 08/01/16 as requested. Picture of the current permitted field.
