PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1. The main purpose of this inspection was to discuss and clarify portions of the permit renewal application that is currently under review. This was Mr. Chao’s first visit to the facility. 2. The site was clean and appeared to be well-maintained. No windblown litter was evident. Stockpiles of processed and unprocessed materials were neat and accessible from all sides. Several piles of unprocessed material had been processed and removed from the site since the last inspection on November 28, 2017. 3. The working face was small, and a review of the cover log revealed that all of the waste had been covered with 6” of clean soil on May 25, 2018. 4. Landfill and excavation slopes were in good repair and appeared to generally be graded to the maximum 3:1 slope, as required by general permit condition #8 in the current Permit to Operate (dated June 28, 2013). 5. No visible signs of erosion were apparent during this inspection. 6. A large pile of logs was staged to the east of the working face. Mr. Phillips stated that these are separated from incoming loads and will be transported to the sawmill for processing. 7. The inert debris treatment and processing area, located at the eastern end of the facility, also appeared to be well-maintained. Processing equipment is situated in the middle of the area, and piles of processed concrete were staged around it. Mr. Phillips stated that the concrete is crushed into specific sizes based on customer orders. He added that crushing takes place onsite as often as required to maintain the desired stockpiles of materials and to keep storage space for unprocessed material to a minimum. 8. During the inspection, several truckloads of concrete, brought from a nearby driveway replacement project, were dropped off. Mr. Phillips made note of the number of truck loads the company had brought to the facility and the volume of the trucks being used to haul the waste concrete. 9. The entire site is designed to drain to a sediment trap located at the southeastern tip of the property. 10. The sediment trap appeared to be overgrown with weeds and woody vegetation, and it was difficult to assess the functionality of the device. Mr. Phillips stated that he would clean out the sediment basin as quickly as possible. Ensure that the sediment trap is cleared of sediment and vegetation, and that it is monitored after measurable rainfall events to confirm that it is functioning properly. 11. Discussion ensued concerning the 3+ acres indicated on the permit renewal request that are labeled as landfill disposal area. Mr. Phillips stated that it was the intent of the business to develop 8.82 acres of landfill space. He added that a new lot had been created for the landfill, and that ownership had transferred to Andrew Veach. Mr. Chao advised him that if the intention is to expand the proposed landfill footprint, a new survey would need to be submitted, along with a deed showing the 8.82-acre fill area plus the required 100’ buffers surrounding it. He also advised Mr. Phillips to enquire as to whether the county special use permit would still be valid as is, or whether it would need to be revised or re-issued. Mr. Chao pointed out that the erosion and sedimentation control plan, approved in 2012, would need to be revised to include the additional disturbed/fill area, the revised drainage plan, and the size and location of the sediment basin. 12. Mr. Phillips stated that he would contact Andrew Veach, the project surveyor and the project engineer to get the changes incorporated into a revised permit renewal request. Mr. Chao confirmed that Mr. Phillips had his contact information, and encourage him to call or email with questions or for additional assistance.
