PURPOSE OF SITE VISIT:
Partial Facility Compliance Inspection without records review to discuss corrective measures required to bring the site
back into compliance
STATUS OF PAST NOTED VIOLATIONS:
1) 15A NCAC 13B .0505 (4)(b) states “Adequate erosion control measures shall be practiced to prevent
excessive on-site erosion.” Unresolved
2) 15A NCAC 13B .0505 (5)(b) states “Surface water shall not be impounded over or in waste.” Unresolved
3) 15A NCAC 13B .0505 (5)(c) states “Completed areas shall be adequately sloped to allow surface water
runoff in a controlled manner.” Unresolved
4) 15A NCAC 13B .0505 (6)(a) states “Within six months after final termination of disposal operations at the
site or a major part thereof or upon revocation of a permit, the area shall be stabilized with native grasses.”

ADDITIONAL COMMENTS:
1) This Facility is a closed Municipal Solid Waste (MSW) Landfill.
2) The Facility access road is of all-weather construction and is being well maintained at this time.
3) The site is secured by a locked gate at the Facility entrance. The gate was unlocked and open upon my arrival
and the attendant was on-site during this Facility Compliance Inspection.
4) An all-weather perimeter road is maintained around the landfill for access to the Facility monitoring wells and
to perform Facility maintenance and inspections.
5) The Facility groundwater monitoring wells were reviewed during this Facility Compliance Inspection. All the
wells were properly labeled, secured with locks, and had well maintained access.
6) Soil has been stockpiled adjacent to the landfill access road for use in repair and maintenance of the landfill
cap system.
7) Compost and ground mulch have been staged adjacent to the landfill for use is cover and grading repairs.
8) Highly visible edge-of-waste markers have been installed and are being maintained throughout the Facility as
required.
9) Conditions at this Facility remain largely unchained from the previous Facility Compliance Inspection.
Required corrective measures were discussed during the on-site meeting with Mr Billy Merkley of the
Carteret County Public Works Department.
10) The perimeter surface water drainage ditch needs to be cleared of brush, woody vegetation, and other
overgrown grasses to provide for positive drainage of surface waters from the Facility.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

11) Areas of differential settlement were observed in several areas around the landfill. Some of these areas are
restricting the positive flow of surface waters from the landfill during and following rain events. *Within
thirty days of receipt of this Facility Compliance Inspection Report, please fill and grade these areas to
promote positive drainage of all surface waters away from the landfill. All filled areas should be graded at a
slope not greater than 3:1 and seeded and mulched to establish a cover crop suitable to prevent erosion of your
landfill cap system.
12) Overall, the landfill has a well-established and well maintained cover crop of native warm season grasses.
However, areas of sparse cover and exposed soil were observed in several areas around the landfill. *Within
thirty days of receipt of this Facility Compliance Inspection Report, please grade, seed, and mulch these areas
to establish a groundcover suitable to prevent erosion of your landfill cap system.
13) Areas of erosion were observed in several places on the landfill. * Within thirty days of receipt of this Facility
Compliance Inspection Report, please fill these eroded areas, grade at a slope not greater than 3:1, seed, and
mulch to establish a groundcover suitable to prevent erosion of your landfill cap system.
14) No off-site erosion was observed during this Facility Compliance Inspection.
15) The landfill sideslopes are being maintained clear of trees and other woody vegetation.
16) *Corrective actions are required as a result of this Facility Compliance Inspection report.
