SWCD-78-01 Compost Demonstration Approval Condition: (1) The approval period is from April 1, 2018 to March 31, 2019.

OBSERVED VIOLATIONS:
SWCD-78-01 Compost Demonstration Approval Condition: (6) Operation of the facility and compost monitoring
activities shall be in accordance with the approved application and Section .1406 of the Solid Waste Management
Rules.
1. Section 13B .1406(1)(A) states that: “construction plans and conditions of permit must be followed.”
Enviro-Choice is in violation of Section 13B .1406 (1)(A) in that the facility has not been constructed nor is it being
operated in a manner consistent with the approved pilot demonstration application.
2. Section 13B .1406(4) states that: “leachate shall be contained on site treated to meet standards of the off-site
disposal method.”
Enviro-Choice is in violation of Section 13B .1406 (1)(A) and (4) in that leachate was not managed in accordance
with the approved application and Compost Pilot Project Conditions for Approval and in that leachate was not

contained onsite but flowed into unpermitted areas outside of the approved composting areas.
Specifically, SWCD-78-01 Compost Demonstration Approval Condition Number 4 states “The site shall be
prepared to control run-off and run-on. Best management practices shall be utilized for this purpose. All run-off
from the site and any leachate generated shall be managed to prevent any impact to ground or surface waters”.
The demo application stated that “Leachate- The buffers of the pad will have a 2-3 foot earthen dike around
them to contain any runoff. All runoff will be channeled to a sediment trap with an outfall into a small detention
area/pond.” The berm as constructed out of mulch-like material, not soil as described in the application and
was observed seeping as noted in comment #4 below.
3. Section 13B .1406(4) states “A site shall only accept those solid wastes that it is permitted to receive”
Enviro-Choice is in violation of the above rule in that it has discharged untreated and/or partially treated
septage water (comingled grease trap waste) from SDTF-78-22 into the compost area. While the
compost demo can accept and manage dewatered solids from the SDTF, it is not allowed to accept
wastewater in accordance with SWCD-78-01 Compost Demonstration Approval Condition #3.
4. SWCD-78-01 Compost Demonstration Approval Condition #9 states “The area which will be used the Compost
Demonstration must be clearly delineated on that field with posts such that septage is not sprayed within the
composting area.”
Enviro-Choice is in violation of the above condition in that the facility is operating without posting the boundaries
of the compost demo.
ADDITIONAL COMMENTS
1. The purpose of this inspection was to follow up on construction of the windrows that were discussed on site
during the May 23, 2018, technical assistance site visit with Donna Wilson, Permitting Engineer and Shawn
Mckee, Environmental Senior Specialist.
2. During this inspection, liquid waste (partially and/or untreated wastewater from SDTF-78-22) was observed
ponded within the compost area. Wastewater is not an approved feedstock for this operation. The ponded
waste shall be removed via pump truck and retreated as unprocessed grease trap waste.
3. The liquid appeared to be seeping out of the berm that was constructed out of the compost material. The liquid
was not running outside of the boundaries of the compost operation at the time of this inspection. All leachate
must be managed per the specifications listed in the approved compost demo application.
4. The compost area must be properly constructed per the specifications listed in the approved compost demo
application.
5. The compost area must be delineated and clearly posted per the conditions of the SWCD-78-01 Compost
Demonstration Approval.
6. Cody Hunt was not present during this inspection. Mr. Hunt was contacted by phone and informed of the
findings of this inspection and that a Notice of Violation would be issued for the observations listed above.
7. Corrective measures are necessary because of the inspection findings and should be completed within 7 days’
receipt of this report.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
