CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 02C .0108(k) states: “All non-water supply wells, including temporary wells, shall be secured with a locking well cap to ensure against unauthorized access and use.” No change has occurred since the previous inspection on May 23, 2018. 2. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 02C .0108(l) states: “All non-water supply wells shall be equipped with a steel outer well casing or flush-mount cover, set in concrete, and other measures sufficient to protect the well from damage by normal site activities.” No change has occurred since the previous inspection on May 23, 2018. 3. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 02C .0108(o) states: “Each non-water supply well shall have permanently affixed an identification plate. The identification plate shall be constructed of a durable, FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 waterproof, rustproof metal or other material approved by the Department as equivalent and shall contain the following information: (1) well contractor name and certification number; (2) date well completed; (3) total depth of well; (4) a warning that the well is not for water supply and that the groundwater may contain hazardous materials; (5) depth(s) to the top(s) and bottom(s) of the screen(s); and, (6) the well identification number or name assigned by the well owner.” No change has occurred since the previous inspection on May 23, 2018. OBSERVED VIOLATIONS: No new violations were observed during this inspection. ADDITIONAL COMMENTS 1. This partial inspection was made at the request of Mr. Brushwood, following a meeting of the Solid Waste Advisory Committee during which landfill compliance was discussed in some detail. 2. The working face of the landfill was observed to be small and well-controlled. No windblown litter was evident at the facility. Mr. Brushwood pointed out the portable windscreens that had been deployed around the working face. He explained that these windscreens had been inspected for deficiencies then put into service as soon as they had been repaired and judged adequate to do the job. 3. The side slopes had again been damaged by the continual heavy rain events experienced since the last inspection on May 23, 2018. However, the cap of the active landfill had been covered and regraded again in preparation for another seeding. Some areas where rain damage had been less severe were green with newly sprouted vegetative cover. 4. No uncovered waste was visible during this inspection, and the deep rills that had been observed previously had all been repaired so that it was not possible to pick out the specific spots where they had occurred. 5. Additional sections of the internal roadway system had been repaired since the previous inspection on May 23, 2018. All access roads driven on during this inspection were found to be in good condition. 6. New cell construction was apparently proceeding as planned, and clay liner testing was in progress. The construction area was clean and well-maintained. 7. The leachate pond in the Phase I area had been the focus of an intense clean-up effort. Mr. Brushwood stated that the entire area within the fence had been bush hogged and mowed, the pond equipment had been inspected and maintenance performed as necessary. He explained that the City of Lexington had been having system issues that forced a reduction in the amount of leachate that could be accepted from the landfill. He added that he had been hauling leachate to Shamrock Environmental when necessary to keep the pond in compliance. 8. The removal of trees and woody plants had begun on the Phase I closed landfill. It appeared that the ditch lines had been cleared of this growth. Mr. Brushwood pointed out some small trees that had sprouted next to a slope drain and stated that the clearing work would continue as the slopes dried and became accessible to heavy equipment. 9. Several bags of some type of tile were found in the inert debris stockpile area. Mr. Brushwood stated that he had been made aware of the material earlier that day and would deal with it before the end of operations. Please ensure that the bags of unacceptable material are removed from the inert debris stockpile and properly disposed of at the working face. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The entire area has been cleared and cleaned and maintenance is being performed on the pond operational control system to ensure that everything functions as designed.
