STATUS OF PAST NOTED VIOLATIONS:
No violations noted on the previous inspection conducted on 01/20/17.
OBSERVED VIOLATIONS:
1) Storage tanks are currently setting mostly on the adjoining property. This is a violation of Rule .0841(m)(4) that
states “Septage detention and treatment facilities shall adhere to the following minimum setback requirements:
Property lines – 50 feet.” Tanks need to be moved to meet the minimum setback requirement of 50 feet to the
property line.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

AREAS OF CONCERN AND COMMENTS:
1) Received calls on 05/11/17 and 05/15/17 that the septage storage tanks where located on the adjacent property.
The adjacent land had recently been purchased by the Tar River Land Conservancy. The property border had been
surveyed and was mark. The tanks were across the property line and need to be moved. Placed orange flags
marking the 50 ft setback from the property line. See pictures below. Met with Allie and told him that the tanks
would have to be moved 50 ft from the property line and that I had placed flags marking 50 ft from the property
line. The current landowner has met with Allie and will give him until August 1st to move the tanks.
2) "No Trespassing" sign present as you get to the land application site.
3) Inspected four metal tanks. Tanks accessible for inspection. Vegetation starting to grow by the tanks. Vegetation
needs to be maintained so that the tanks can be inspected.
4) The first tank from the left has a hole, about ¼ inch in diameter, near the bottom of the front end. No septage
leaking from the hole today. Tank not currently being used. Hole needs to be patched.
5) Septage transfers to and from the tanks appear to be handled in a safe and sanitary manner. No septage spills
noticed around the tanks.
6) No objectionable odor or vector issues noticed today.
7) The tanks appear to be used on a regular basis.
