PURPOSE OF SITE VISIT: Routine
STATUS OF PAST NOTED VIOLATIONS:
Observed violation noted to Rule .0841(m)(4) for the storage tanks setting mostly on the adjoining property on the
previous inspection.
OBSERVED VIOLATIONS:
1) The storage tanks have been moved completely onto the permitted site. However, the tanks are still within the
50 feet setback requirement to the property line. This is a violation of Rule .0841(m)(4) that states “Septage
detention and treatment facilities shall adhere to the following minimum setback requirements: Property lines –
50 feet.” Tanks need to be moved to meet the minimum setback requirement of 50 feet to the property line.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

AREAS OF CONCERN AND COMMENTS:
1) Had received call that the tanks had been moved.
2) Tanks had been moved so that they were no longer on the adjoining property. Tanks still within 50 ft setback
requirement to the property line. Tanks need to be moved outside the 50 ft setback requirement. We discussed a
possible area and tank alignment as to where the tanks could meet the 50 ft setback requirement and not take up
much area from the septage land application site.
3) Signage present.
4) No leaks or septage spills noticed.
