PURPOSE OF SITE VISIT:
Partial Inspection
STATUS OF PAST NOTED VIOLATIONS:
1. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 02C .0108(k) states: “All non-water supply wells,
including temporary wells, shall be secured with a locking well cap to ensure against unauthorized access and
use.” Locks had been installed on most monitoring wells that had been lacking them. For those wells
requiring other upgrades or repairs, locks will be installed when well caps are installed during the new cell
construction.
2. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 02C .0108(l) states: “All non-water supply wells shall
be equipped with a steel outer well casing or flush-mount cover, set in concrete, and other measures sufficient to
protect the well from damage by normal site activities.” Repairs and upgrades to the monitoring wells that
were cited as having deficiencies in the well casing and concrete pad will be addressed during during the
new cell construction.

3. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 02C .0108(o) states: “Each non-water supply well
shall have permanently affixed an identification plate. The identification plate shall be constructed of a durable,
waterproof, rustproof metal or other material approved by the Department as equivalent and shall contain the
following information:
(1) well contractor name and certification number;
(2) date well completed;
(3) total depth of well;
(4) a warning that the well is not for water supply and that the groundwater may contain hazardous materials;
(5) depth(s) to the top(s) and bottom(s) of the screen(s); and,
(6) the well identification number or name assigned by the well owner.”
All monitoring wells have had the required permanent identification tags installed or updated, except for
LFG-9 and any deficient wells that require repair or upgrade. These tags will be installed during the new
cell construction.
4. RESOLVED: 15A NCAC 13B .1626(2)(a) states: “the owners and operators of all MSWLF units must cover
disposed solid waste with six inches of earthen material when the waste disposal at the end of each operating
day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter, and
scavenging.” The working face of the active landfill was observed to be small and well-compacted. No
uncovered waste was found outside of the working face. All side slopes, as well as the top of the landfill
cap, had been covered with at least 12” of clean soil, regraded and seeded. The areas surrounding the
new landfill gas wells had been repaired and covered as well. Due to continued heavy rains, many of these
areas will require repair and re-seeding in order to stabilize the cap with a vegetative cover. Although
several deep rills were observed on the landfill side slopes, no waste was exposed in these areas, and
repairs were seen to be under way. Mr. Brushwood stated that, weather permitting, slope repairs would
be completed and additional seeding would take place during the week of May 28th.
5. RESOLVED: 15A NCAC 13B .1626(2)(c) states: “Areas which will not have additional wastes placed on them
for 12 months or more, but where final termination of disposal operations has not occurred, shall be covered with
a minimum of one foot of intermediate cover.” See comments in Observed Violation 4, above.
OBSERVED VIOLATIONS:
No new violations were observed during this inspection.
ADDITIONAL COMMENTS
1. This partial inspection was made following a construction meeting for the new Phase 2 cell.
2. The working face of the landfill was observed to be small and well-compacted. Mr. Brushwood stated that, despite
additional equipment issues, operations had returned to normal; the working face is covered daily, as required; and,
waste that is being uncovered during the liner tie-in work for the new cell construction is being brought directly to
the working face for immediate disposal.
3. All of the side slopes and the top of the cap of the active landfill had been covered and regraded, and some newly
sprouted vegetative cover was visible in some spots. Large areas of the slopes had been damaged by the continuing
heavy rainfall experienced over the past month. However, no uncovered waste was observed in the erosion rills, and

administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

slope repairs were under way. Mr. Brushwood stated that he had scheduled the seeding contractor to return the week
of May 28th.
4. Progress had been made in the removal of woody plants previously observed to be growing along the slope drains
and the perimeter ditch of the active landfill unit. Mr. Brushwood stated that this work is being accomplished in
small areas at a time while slope repairs are being undertaken. He added that erosion control, slope repairs are his
immediate priorities, and that other clean-up work takes place as it can be worked into the schedule.
5. The four leachate repair areas previously observed along the southern slope of the landfill had been regraded and
seeded. No additional seeps were observed.
6. Uncovered waste that had been previously observed in depressions around the new landfill gas extraction wells had
been removed, and the depressions had been filled with clean soil and graded to match the surrounding slopes.
7. Repairs had been made to several areas of the internal roadway system that had been previously observed to be
rutted and eroding. Mr. Brushwood explained that, while additional repair work is needed, the roadways are now
stable and easily navigable by heavy trucks and equipment.
8. Portable wind screens had been installed around the daily operations area and the working face. Mr. Brushwood
stated that additional wind screens would be deployed once they were repaired.
9. The entire Phase 2 side of the facility was found to be clean and neat. No windblown trash was observed outside the
daily operations area.
10. The new cell construction was observed to be proceeding quickly. Based on discussion at the construction meeting,
held prior to this inspection, clay liner testing would take place the week of May 28th. The area was clean and well-
maintained.
11. Mr. Brushwood stated that the side gates that secure the HHW collection area had been repaired and have been kept
locked when the site is not in use. The HHW collection area was not inspected on this date.
