Permit Condition 2. This site shall be operated and maintained in accordance with the nutrient management plan. During this May inspection the rye had not been harvested from either field and was very tall which adversely affects (shades out) the emerging bermuda. Remove the rye from the site and establish the required field rotation as per the nutrient management plan. It also appeared that land application may have occurred on the left field. Land application on a very tall cropstand is not a good land application procedure as “lodging” may occur. Discussed the situation with Mr. Cummings by phone. SEE BACK OF PAGE The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. A notification letter was sent April 2, 2018 in regards to the land application site permit expiring on August 15, 2018. As of this date this office has not yet received the renewal submittal. Submit the renewal application at this time in accordance with Rule .0835(g) which states that the renewal application shall be submitted at least 90 days prior to the expiration date. 2. Noted a significant amount of weeds on site. Weed control is needed after the rye is harvested. Contact Georgia Love (regional agronomist) 910-690-0270 for advice. 3. Field markers appear adequate but noted a leaning marker at the front of the site. It appears that the approved setbacks are being met but were not measured at this time. No apparent sign of land application outside the permitted boundaries. No sign of heavy application. No odors noted. Due to the extremely tall rye it was difficult to adequately inspect the site. 4. The required signs are posted and the access road is adequate. 5. Soil samples shall be taken by the permit holder this fall.
