The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Met to discuss permit modification for proposed dewatering facility. Gary MacConnell with MacConnell &
Associates provided preliminary drawings which were reviewed. Discussed the normal setback requirement for
the two new storage tanks that have been placed – required 100 foot setback from tanks to creek. Discussed
setback requirement for high capacity (which these two tanks fall under/are not grandfathered like the other
existing tanks) – up to double setbacks or 100% containment per Rule .0841(o). Discussed containment options
at the current tank location. Discussed possible new locations for the tanks (up hill/near building) where double
setbacks may be present without the need for containment. A new survey has not been performed yet. Discussed
general layout of the facility & waste process.
2. Some additional clearing has been done (since the last visit on 5/04/2018) to the left and partly behind the tanks
along the creek. Measured various approximate distances from the front of the building to the well house, from
the tanks to the creek and from the creek up hill to the area to the side of the building. Surveyor will need to
verify the 100 foot setback from the current position of the two new tanks to the actual creek location.
3. The two new tanks are currently not permitted and shall not be used for septage detention.
4. Did not inspect the land application site at this time. Aaron Cheek stated that he believed that the gate entrance
had been repaired at Field 3.
